<br /> This instrument, made this 18th day of January, 2012, between Eric H. Lindquist, a
<br /> member of the Nebraska State Bar Association, Successor Trustee, hereinafter called
<br /> "Grantor", pursuant to a power of sale contained in that certain Deed of Trust recorded on
<br /> December 12,2003 as Instrument No. 0200315952 in the o�ce of the Register of Deeds of
<br /> Hall County,Nebraska, and Federal Home Loan Mortgage Corporation, hereinafter called
<br /> "Grantee".
<br /> WHEREAS, on May 20, 2010, Grantor, executed a Notice of Default pursuant to
<br /> which notice was given to Russell O. Forsythe and Lori A. Forsythe, husband and wife,
<br /> Trustors,under that certain Deed of Trust recarded on December 12,2003 as Instrument No.
<br /> 0200315952 in the office of the Register of Deeds of Hall County,Nebraska, covering that
<br /> certain premises described as:
<br /> LOT 63, CASTLE ESTATES, AN ADDITION TO THE CITY OF
<br /> GRAND ISLAND,HALL COLINTY,NEBRASKA,
<br /> that a breach of an obligation for which the trust property was conveyed had occurred, and
<br /> setting forth the nature of such breach and of his election to sell or cause to be sold such
<br /> property to satisfy the obligarion. Said Notice of Default was filed for record in the Office of
<br /> the Register of Deeds of Hall County, Nebraska, on May 24, 2010, as Instrument No.
<br /> 0201003534.
<br /> A copy of such Notice of Default was thereafter mailed to a11 parties entitled to notice
<br /> pursuant to said Deed of Trust and in compliance with Neb.Rev.Stat.§76-1008.
<br /> Subsequent thereto,beginning on December 1,2011, Grantor caused to be published
<br /> in the Grand Island Independent,a newspaper ha�ing a general circulation in Ha11 County,
<br /> Nebraska,a Notice of Trustee's Sale setring forth a description of the property to be sold and
<br /> stating that the described property would be sold at public auction to the highest bidder for
<br /> cash or certified or cashier's check,at the lower level lobby of the Hall County Courthouse,
<br /> 1 st&Locust Street, Grand Island,Hall County,Nebraska at 2:00 p.m. on January 17,2012.
<br /> Publication of such notice was made for five consecutive weeks on December 1, 2011,
<br /> December 8,2011,December 15,2011,December 22,2011 and December 29,2011,the last
<br /> publication being at least ten(10)days but not more than thirty(30)days priar to the date of
<br /> sale.
<br /> A copy of such notice of the time and place of sale was thereafter mailed to all parties
<br /> entitled to notice pursuant to said Deed of Trust and in compliance with Neb. Rev. Stat.
<br /> §76-1008.
<br /> Pursuant to said Notice of Trustee's Sale, John B. McDermott, attorney far Grantor,
<br /> did at the time and place mentioned in said Notice of Trustee's Sale, offer said properiy for
<br /> sale at public aucdon,and did sell the same to JPMorgan Chase Bank,National Association,
<br /> successor by merger to Chase Home Finance LLC for the sum of$103,846.42, it being the
