<br /> THIS DEED entered into this � � `day of February, 1972 by and
<br /> between Arthur C. Mayer, Executor under the Last Will and Testament
<br /> of George Ehlers, deceased, Grantor, and John Niedfelt and Jerome
<br /> Niedfelt, of Ha11 County, Nebraska, as tenants in common, Grantees.
<br /> WITNESS, that the Grantor, being duly appointed, qualif ied and
<br /> , acting Executor o� George Ehlers, deceased, under his Last Will and
<br /> Testament, admitted to probate in the County Court of Hall County,
<br /> Nebraska, by virtue of the power and authority granted him under said
<br /> Will, and in consideration of the sum of Twenty-Eight Thousand Six
<br /> Hundred Forty Dollars ($28,640.00) to him paid by Grantees, receipt
<br /> whereof is hereby acknowledged, does by these presents grant, bargain,
<br /> sell, remise, release, convey, and confirm unto the Grantees, as tenants
<br /> in common, and to their assigns forever, the following described real
<br /> estate, to-wit:
<br /> All my right, title, and inte rest, as Executor, in and to
<br /> the We st Half of the Southeast Quarter (W�SE 4) of Section
<br /> Twenty-Five (25) , in Township Eleven (11) North, Range
<br /> Nine (9) , West of the 6th P.M. , in Hall County, Nebraska,
<br /> sub,ject to any easements, covenants, rights-of-way and
<br /> roads.
<br /> Together with all and singular the tenements, hereditaments and appurten-
<br /> ances thereunto belonging or in anywise appertaining and also all of tl-�
<br /> estate, right, title, interest, property, possession, claim and demand
<br /> whatsoever, which the said Testator had at the time of his decease, and
<br /> whi:ch the said Grantor has by virtue of the said Last Will and Testa-
<br /> ment, or otherwise, of in or to the above granted premises, and every
<br /> part and parcel thereof with the appurtenances;
<br /> TO HAVE AND To HOLD the said premises with the hereditaments and
<br /> appurtenances thereof untp the said Grantees and to their assigns
<br /> . forever.
<br /> Grantor, f or himself, his successors,heirs, executors, and
<br /> administrators covenants with the Grantees that he is lawf ully the '
<br /> executor under the Last Wi11 and Testament of George Ehlers, deceased;
<br /> that he is lawfully seized of said premises; that said premises are
<br /> f ree from encumbrance except as excepted above, and that he has power
<br /> to convey the same; that he has in a11 respects acted, in making this
<br /> conveyance, pursuant to the authority granted him under the Last Wi1l
<br /> and Testament of George Ehlers, deceased; that he has not done, made, or
<br /> suffered �any act, matter or thing whatsoever, since he was executor of
<br /> said estate, whereby said premises or any part thereof, a re, shall or may
<br /> be impressed, charged,' or encumbered in any manner whatsoever.
