<br /> THIS DEED entered into this 15th day of March, 1972, by and between
<br /> � ° Evelyn Opp Schultz and Herbert F: Mayer, Jr. , executors under the Last
<br /> i Will and Testament of Emma Opp Luebs, deceased, Grantors, and Elton W.

<br /> WITNESSETH, that the Grantors, being. the duly appointed, qualified
<br /> � and acting executors of Emma Opp Luebs, deceased, under her Last Will and
<br /> � Testament, admitted to probate in the County Court of Ha11 County, Nebra ska,
<br /> ± in Es�tate No. 8147, bg virtue of the power and authority granted them under
<br /> i said Will, and in consideration of the sum of Thirty Thousand Four Hundred
<br /> ' Fifty-Two Dollars ($30,452.00) to them paid by Grantee, receipt whereof •
<br /> i is hereby acknowledged, do by these presents grant, bargain, sell, remise,
<br /> � release, convey, and confirm unto Grantee and to his assigns and heirs

<br /> forever all of the -£ollowi�g desc�ibed real estate, to-wit:
<br /> ; An undivided 23/44ths interest in the West Half of the Northeast
<br /> ' �uarter (W�NF4) and the Northeast Quarter of the Northeast
<br /> Quarter (NF�NF�4) and the East Half of the Northwest Quarter
<br /> (E'�NV�) , all in Section Thirty-Six (36) , in Township Ten (10) ,
<br /> North, Range Eleven (11) West of the 6th P.M. , in Hall County,
<br /> Nebraska.
<br /> Excepting that portion of said tract deeded to Rudolph Luebs,
<br /> as recorded in Book 143 at Page 626 of the Deed Records of
<br /> Ha1.1 County, Nebraska, and
<br /> excepting that portion of said tract deeded to Union Oil
<br /> � Company of California, a California Corporation, as recorded
<br /> in Book 156 at Page 119 of the Deed Records of Hall County,
<br /> Nebraska, and
<br /> excepting that portion of said tract condemned by the �tate
<br /> of Nebraska, Department of Roads, as set forth in the return
<br /> of appraLSers recorded in Book 9 at Page 427 of the Miscellaneous
<br /> � Records in the office of the Register of Deeds of Hall County,
<br /> Nebraska,
<br /> Together with all and singular the t�nements, hereditaments and appurten-
<br /> ances thereunto belonging or in anywise appertaining and also all of the
<br /> estate, right, title, interest, property, possession, claim and demand
<br /> whatsoever, which tYie said Testatrix had in her lifetime, and at the time
<br /> of her decease, and which the said Grantors have by virtue of the said
<br /> Last Will and Testament, or otherwise, of in or to the above granted
<br /> premises, and every part and parcel thereof with the appurenances.
<br /> TO HAVE AND TO HOLD the said premises, with the hereditaments and
<br /> appurtenances the reof unto the said Grantee and to his heirs and assigns
<br /> forever.
<br /> Grantors for themselves, their successors, heirs, executors and
<br /> administrators, covenant with the Grantee that they are lawfully the
<br /> executors under the Last Will and Testament of Emma Opp Luebs; that they
<br /> are lawfully seized of said premises; that said premises are free from
<br /> encumbrance, and that they have the power to convey the same; that they
<br /> � have in al1 respects acted, in making this coriveyance, pursuant to the
<br /> authority granted them uxider the Last Will and Testament of Emma Opp
<br /> Luebs, deceased; that they have not done, made, or suffered any act,
<br /> �r,.atte r or thing whatsoeve r, since they we re executors of thi s e state,
<br /> whereby said premises or any part thereof, are, shall, or may be impressed,
<br /> charged, or encumbered in any manner whatsoever; that they will promptly
<br /> comp]ete the estate of Emma Opp Luebs, deceased, and will effect a release
<br /> of any existing or potential liens against these premises arising f rom such
<br /> estate proceedings.
