<br /> KNOW ALL MEN BY TH�SE P�:�SEI��:. Whereas , in an action of
<br /> partition pending in the District Court of .Hall County, Nebraska,
<br /> wher.e Ruth Hostler was Plaintiff and Charlie Cole and Beth Cole, his
<br /> wife, el at, were Defendants, for the partition of the premises here-
<br /> inafter described, the undersigned Referee, appointed by said Court
<br /> to make partition of said real estate , made report in writing, duly
<br /> signed, setting forth that partition of said real estate could not
<br /> be made without great prejudice to the owners thereof, which report
<br /> was duly examined by th� Court and said Court being satisfiea there-
<br /> with confirmed the same , and thereupc�n made an order and caused the
<br /> same to be entered, directing me as said Referee to sell said prem- .
<br /> ises on the following terms , to-wit: rifteen per cent cash and the
<br /> balance upon confirmation; and in pursuance of said order Z caused
<br /> a notice to be published in the Grand Island Daily Independent , a
<br /> newspaper printed in general circulation of Hall County, that I
<br /> would offer said real estate for sale on the premises in said
<br /> County on the $th day of November, 19'71, at 1:00 P .Ni. of said day,
<br /> and at the time and place stated in said notice, and after said
<br /> notice had been published for more than thirty days I offered said
<br /> real estate, to-wit : The Easterly One-Half (E2) of said Lot Six
<br /> _ (6)., Block Twenty (20) , Packer and Barr's Second Addition to the
<br /> City of Grand Island, Hall County, Nebraska f'or sale at public auc-
<br /> tion and sold the same to Clement Cole and Nodine Cole, husband �nd
<br /> wife , as joint tenants and not as tenants in common, f�r the sum o1'
<br /> �1�,15G.00, they being the highest bidders therefcre. And afterwards
<br /> on November 19, 1971, said Court approved and confirmed said sale
<br /> and by an order directing me as said Referee to execute to saici
<br /> purchasers a Deed conveying said lands to �hem as joint tenants in
<br /> fee simple .
<br /> Now therefore, I, James Livingston, Ref'eree, in consideration
<br /> of the premises and the sum of $4.,15G.CU so bid and paid by said
<br /> purchasers, and �by virtue of. the powers vested in my by law, cio by
<br /> � these presents grant , sell, and ccnvey ur.to Clement Cole and iJodS_n�
<br /> Cole , husband and wife , as joint tenants and nct as tenants ir,
<br /> corunon, and to their assigned , or tc the hei.rs and ass:igns of the
<br /> survivor of them, the real estate. described as the Easte.rly Gne-Half
