assigns and tenants , at all times hereafter, for all purposes connected '

<br /> ever purpose the said land may be from time to time lawfully used
<br /> and enjoyed, to pass and repass along the following described parcel

<br /> A tract of land camprisin a part of the Southeast Quarter
<br /> of the Northeast Quarter �SE4NE4) of Section Twenty-four (24) ,
<br /> . Township Eleven (11 ) North , Range Ten (10) , West of the 6th
<br /> P .M. , in Hall County , Nebraska , more particularly described
<br /> as fol1ows : Beginning at a point on the East line of said
<br /> Section 24, said point being Six Hundred Eighty-eight and
<br /> Fifteen Hundredths (688. 15) feet North of the Southeast corner
<br /> of said Northeast Quarter; thence .Northerly along the East
<br /> 1ine of said Section 24, a distance of Forty-six and Fifty-
<br /> one Hundredths (46 .51 ) feet; thenee deflecting left 120° 40 ' 30"
<br /> and runaing Southwesterl.y, a distance of Four Hundred Sixty-five
<br /> and Sixty-five Hundredths (465 :65) feet; thence deflecting left
<br /> 89042 ' and running Southeasterly , a distance of Forty (40 .0) �
<br /> feet; thence deflecting left 900 18' and running Northeasterly
<br /> a distance of Four Hundred Forty-two and Nine Hundredths
<br /> (442 .09) feet to the place of beginning and containing 0.417
<br /> acres more or less , a plat of which is attached hereto and
<br /> made a part hereof,
<br /> for the purpose of going from the said Webb Road to the, said property
<br /> described above , owned by Grantees , or visa versa , and to further
<br /> utilize that property for the purpose of supplying necessary utilities
<br /> to said property o,wned by Grantees . Grantees m�y construct and main-
<br /> tain a roadway 25 feet in width (the Southerly edge of which is five
<br /> (5} feet North of the Southerly edge of the easement granted hereby)
<br /> on such easement at substantially the sa�e elevations and grades as
<br /> are presently established or as may be -mutual1y agreed upon from time
<br /> to time by said Grantors and said Grantees , or their respective heirs ,
<br /> executors , administrators or assigns . Grantors agree not to obstruct
<br /> the roadway on such easement and �Grantees , by accepting this easement ,
<br /> � also agree not to obstruct such roadway .
<br /> To have and to hold the said Easement or Right-of-Way hereby
<br /> granted to the Grantees , their heirs and assigns , as appurtenant to
<br /> the said land of the Grantees and every part thereof.
<br /> .Said Easement is given upon the express understanding and condi -
<br /> tion that the same may be used by� Grantees , their heirs , executors ,
<br /> administrators and assigns , in conjunction with the use of the _
<br /> Grantors , and Grantors' successors , assigns and tenants ; also , that
<br /> Grantors , Grantors ' successors and assigns may grant similar easements
<br /> and right-of-way to other persons over the same easement and right-of-
<br /> way granted herein ; pr��ided, however, that if similar easements are
<br /> granted to any other person , Grantors herein agree to require such
<br /> other person to participate in maintenance of such roadway on a fair
<br /> and equitable basis ; also, that the Grantors , Grantor`s ' successors ,
<br /> assigns and tenants will be in ,no way bound to construct the roadway
<br /> or keep the same in repair, nor do Grantors , Grantors ' successors
<br /> or assigns , assume any liability or responsibility to the Grantees ,
<br /> their heirs , executors , administrators or assigns , .or any person using
<br /> said road by invitation expressed or implied , or ,by reason of any
<br /> business conducted with Grantees , their heirs , executors , administrators
<br /> or assigns , or otherwise.
<br /> It is further understood that said Easement will' terminate at
<br /> such time as the Grantees , their heirs , executors , administrators or
<br /> . assigns , shall abandon the use .of said Easement or fail to maintain
<br /> said Easement in safe condition or in the event that any public road-
<br /> � way sha11 ever be established which" is used by Grantees to service
<br /> the afo'redeseribed property of Grantees for "ingress a;nd egress and
<br /> for utilities .
