<br /> EXECUTOR'S DEED '"�'"°�°—`
<br /> THIS DEED made this 13th day of April, 1971, by and between. John A.
<br /> Bottorf, of Sutton, Clay County, Nebraska, Executor of the Last Will
<br /> and Testament of Blanche B. Bottorf, Deceased, .late of Hall County,
<br /> Nebraska, party of the first part, and ,
<br /> ROGER A. FINNIGSMIER and CONNIE A. FINNIGSMIER
<br /> Husband and Wife as Joint Tenants with rights
<br /> of Survivorship and not as tenants in common,
<br /> parties of the second part.
<br /> WITNESSETH, That the said party of the first part, the
<br /> duly appointed, qualified and acting Executor of the Estate of
<br /> Blanche B. Bottorf, Deceased, under her Last Will and Testament,
<br /> � which is of record in the office of the Probate Court of Hall County,
<br /> Nebraska, by virtue of the power and authority, granted and conferred
<br /> upon him, under said Will, and in consideration of the payment to him
<br /> of the sum of THIRTEEN THOUSAND FIVE HUNDRED ($13,500.00) DOLLARS,
<br /> by said second parties, the receipt whereof is hereby acknowledged,
<br /> �does by these presents grant, bargain, sell, remise, release, convey
<br /> • and confirm unto the said parties of the second part and to their
<br /> assigns, or to the heirs and assigns of the survivor of them forever,
<br /> all of the following described real property in Hall County, Nebraska:
<br /> . Lots 7 and 8, of Block 39, Russel Wheeler' s Addition
<br /> to the City of Grand Island, Hall County, Nebraska
<br /> TOGETHER WITH all and singular the tenements, hereditaments and
<br /> appurtenances thereunto belonging or in any wise appertaining; and
<br /> also all the estate, right, title, interest, property, possession,
<br /> claim or demand whatsoever, which said Testatrix had in her lifetime,
<br /> and at the time of her deceased, and which the said party of the first
<br /> part has, by virtue of the Last Will and Testament or otherwise, of,
<br /> in or to the above described premises and every parcel thereof.
<br /> To have and to hold the above described premises, together
<br /> with all the tenements, hereditaments and appurtenances thereunto
<br /> belonging unto the said parties of the second part and to their
<br /> assigns, or to the heirs and assigns of the survivor of them forever.
<br /> IT BEING THE INTENTION OF ALL PARTIES HERETO THAT IN THE EVENT OF THE
<br /> DEATH OF EITHER OF SAID GRANTEES, SECOND PARTIES, THAT THE ENTIRE FEE
<br /> SIMPLE TITLE TO THE REAL ESTATE SHALL VEST IN THE SURVIVING GRANTEE.
<br /> And the said party of the first part, for himself, his heirs,
<br /> executors and administrators does covenant, promise and undertake to
<br /> and with the said second parties, their assigns or the heirs and
<br /> assigns of the survivor of them, that he is lawfully the Executor of
<br /> the Last Will and Testament of said Blanche B. Bottorf, Deceased, and
<br /> has power to convey as aforesaid, in pursuance of the authority granted
<br /> in and by said Last Will and Testament, and that he has not done or
<br /> suffered any act, matter or thing whatsoever, since he was executor
<br /> as aforesaid, whereby the above granted premises, or any part thereof
<br /> are, shall or may be impeached, charged or encumbered in any manner
<br /> whatsoever.
<br /> IN WITNESS WHEREOF the said party of the first part has here-
