<br /> THIS INDENTURE made this �`�day of June , 1971 , by and
<br /> between GWYER GRIMMINGER, Administrator with Will Annexed of the
<br /> Last Will and Testament of Amanda D . Schmidt , deceased, late of Hall
<br /> Co�nty , State of Nebraska, Party of the First Part, and GLENN SCHWARZ ,
<br /> of Hall County , Nebraska , Party of the Second Part , WITNESSETH :
<br /> That the said Party of the First Part is the duly appointed ,
<br /> qualified and acting Administrator with Will Annexed of the Estate
<br /> of Amanda D . Schmidt , deceased; that under the Last Will and Testa-
<br /> ment of Amanda D . Schmidt , which is of record in the Office of the
<br /> County Court of Hall County , Nebraska, decedent ' s brother, Arnhold
<br /> 0 . Koehler, was named Executor, but that Arnhold 0. Koehler preceded
<br /> the decedent in death and the County Court of Hall County , upon the
<br /> Petition of Louise Ries , niece of the decedent, and due notice
<br /> appointed Gwyer Grimminger Administrator with Wi11 Annexed .
<br /> By virtue of the power and authority granted and confer�ed
<br /> upon Gwyer Grimminger, Administrator with Wi11 Annexed, under the Last
<br /> Will and Testament of Amanda D . Schmidt, deceased, and in considera-
<br /> tion of the s.um of $5 ,806 .20 , to him paid by the Party of the Second
<br /> Part, receipt whereof is hereby acknowledged, does by these presents
<br /> grant , bargain , sell , remise , release , convey and confirm unto the
<br /> Party of the Second Part, all of the following real property situated
<br /> in Hall County , Nebraska:
<br /> Lot Two (2 ) , in Block Three ( 3) , in South Grand
<br /> Island, an Addition to the City of Grand Island,
<br /> Nebraska ,
<br /> together with all hereditaments and appurtenar�ces thereto belonging
<br /> and also all of the estate , right , title , interest, claim and demand
<br /> �rhatsbeuer which the said Testatrix had in her lifetime , and at the
<br /> time of her demise , and which the said Party of the First Part has ,
<br /> by virtue of said Last Will and Testament , in and to the above des - .
<br /> cribed premises and every part thereof.
<br /> To have and to hold said described premises with the here-
<br /> ditaments and appurtenances thereof , unto the Party of the Second
<br /> Part , and his heirs or assigns forever.
<br /> An'd the Party of the First Part , for himself, his heirs ,
<br /> executors , and administrators , does covenant , promise and undertake
<br /> to and with the Party of the Second Part , his heirs and assigns that
<br /> he is lawfully the Administrator with Will Annexed of the Last Will
<br /> a�nd Testament of the said Amanda D . Schmidt , deceased, and has the
<br /> power and authority to convey as aforesaid, and has in all respects.
<br /> acted , in making this conveyance , in pursuance of the authority
<br /> granted him 'by the Last Will and Testament of said decedent; that he
<br /> has not made , done or suffered any act , matter or thing whatsoever,
<br /> since his appointment, whereby ,the above demised premises , or any
<br /> part thereof, are , shall or may be impeached , charged or encumbered
<br /> in any manner whatsoever.
