<br /> EXECUTOR'S DEED
<br /> THIS DEED made this '2� � day of May, 1971, by and between Sam
<br /> Kehm, Executor under the Last Will and Testament of Elizabeth Kehm,
<br /> deceased, late of Grand Island, in the County of Hall, State of Nebraska,
<br /> Party of the First Part, and Lydia Speck of Grand Island, Hall County,
<br /> Nebraska, Party of the Second Part;
<br /> WITNESSETH, that the said party of the first part, the duly appoint-
<br /> ed qualif ied and acting Executor of said Elizabeth Kehm, deceased, under
<br /> her Last Will and Testament, which is of record in the County Court of
<br /> Hall County, Nebraska, by virtue of the power and authority granted and '
<br /> conferred upon him under said Will, and in consideration of the sum of
<br /> FIVE THOUSAND DOLLARS ($5,000.00) to him paid by the party of the second
<br /> part, the receipt whereof is hereby confessed and acknowledged, does by
<br /> these presents, grant, bargain, se11, remise, release, alien, convey and
<br /> confirm unto the said party, of the second part and to his hei.rs and
<br /> assigns forever, all of the following described tract, piece and parcel
<br /> of land situate, lying and being in the County of Hall. and State of
<br /> Nebraska, to-wit:
<br /> Lots Five (5) and Six (6) , in Block One Hundred Forty-Five
<br /> (145) in Union Pacific Railway Company's Second Addition
<br /> to the City of Grand Island, Hall County, Nebraska,
<br /> Together with all and singular the tenements, hereditaments and appur-
<br /> tenances thereunto belonging or in anywise appertaining and also all of
<br /> the estate, right, title, interest, property, possession, claim and
<br /> demand whatsoever, which the said Testatrix had in her lifetime, and
<br /> at the time of her decease, and which the said party of the first part
<br /> has by virtue of the said Last Will and Testament, or otherwise, of,
<br /> in or to the above granted premises, and every part and parcel thereof
<br /> with the appurtenances;
<br /> TO HAVE �iND TO HoLD the said premises, the tract of land af oresaid,
<br /> with the hereditaments and appurtenances thereof, unto the said grantee
<br /> and to her heirs and assigns f orever.
<br /> And the said party of the first part, Sam Kehm, for himself and his
<br /> successors, his heirs, executors and administrators, covenants, promises
<br /> and agrees to and with the said party of the second part that he is law-
<br /> fully the Executor of the Last Will and Testament of the said Elizabetb
<br /> Kehm, Deceased; that he is lawfully seized of said premises; that said
<br /> premises are free from encumbrance and that he has power to convey as
<br /> aforesaid, and has in all respects acted, in making this conveyance, in
<br /> pursuance of the authority granted in and by the said Last Will and
<br /> Testament of the said Elizabeth KeY�m, deceased, and that he has not �made,
<br /> done or suffered any act, nratter or thing whatsoever, since he was ex-
<br /> ecutor as aforesaid, whereby the above gr�ted premises or any part
<br /> thereof, are, shall or may be impeached, charged or encumbered in any
<br /> manner whatsoever.
<br /> IN WITNESS WHEREOF the said Sam Kehm, as Executor, has hereunto set
<br /> his hand the day and year first above written.
