<br /> Part of Lot Six (6) of Home Subdivision of that part of the Northwest
<br /> Quarter (NW4) of Section Nine (9) , in Township E1even ( 11 ) North , Range
<br /> Nine (9) , West of the 6th P. M. , which lies West of Wheeler Avenue as
<br /> surveyed , platted and recorded and described as foTlows : Beginning at the
<br /> Northwest corner of Lot Six (6) , thence Southerly 135 feet along the
<br /> Westerly line of said Lot Six (6) , thence Easter7y 250 feet parallel to
<br /> the Northerly line of said Lot Six (6) , thence Northerly 135 feet parallel
<br /> to the Westerly line of said Lot Six (6) , thence Westerly 250 feet alona
<br /> the Northerly line of said Lot Six (6) to the point of beginning , together.
<br /> with any improvements or appurtenances thereto , and together with an ease-

<br /> Grantee , their heirs , successors and assigns shall keep said easement-way
<br /> open and free from obstructions at all times for the movement of traffic ,
<br /> and the same shall not be used for parking , and no buildings or other
<br /> similar structures shall be erected or maintained on the easement-way.
<br /> In further consideration for the granting of such easement , Grantee , its
<br /> heirs ; successors and assigns , aarees to erect and maintain on said ease-
<br /> ment-way a hard-surface drive adequate. for motor vehicle traffic. Grantee
<br /> and its heirs , successors and assigns agrees to repair and maintain such
<br /> driveway in good safe condition, including remova1 of snow and ice as is
<br /> reasonable and necessary from time to time ; provided , that in case of aban-
<br /> donment of such easement by the Grantee , its heirs , successors and assigns ,
<br /> far the purposes above mentioned , or if Grantee , its heirs , successors and
<br /> assigns , fails to repair and maintain such right-of-way as herein provided ,
<br /> the Grantor or Grantor's heirs , successors or assigns , sha11 have the
<br /> right to reenter, and to hold , own and possess such easement-way in the
<br /> same manner and to the same extent as if this conveyance of easement-way
<br /> had never been made.
<br /> To have and to hold the above described premises together with all
<br /> tenements , hereditaments and appurtenances thereto belonging unto the
<br /> grantee and to grantee 's heirs and assigns forever.
<br /> And the grantor for itself and its successors daes hereby covenant
<br /> with the grantee and with grantee 's heirs and assiqns that grantor is law-
<br /> fully seised of said premises ; that they are free from encumbrance ; that
<br /> grantor has good right and lawful authority to convey the same ; and that
<br /> grantor warrants and will defend the title to said premises against the
<br /> lawful claims of all persons whosoever.
