<br /> The City of Grand Island, a municipal corporation, in Hall County, Nebraska,
<br /> as Grantor, for One Dollar ($1.00) consideration, does hereby quitclaim, grant,
<br /> bargain, sell, convey, release, and confirm unto
<br /> . RUDOLF F. PLATE and GLENN SCHWARZ,
<br /> as individuals, herein called the Grantees, the following described real property
<br /> in Hall County, Nebraska:
<br /> � Part of platted Beta Street vacated by Ordinance No. 4�932
<br /> of the City of Grand Island, Nebraska, being the west twenty-
<br /> five (25) feet of the north one hundred twenty (120) feet of
<br /> said Beta Street, adjacent to and lying south from the south ,
<br /> line of Eleventh (11th) Street, all in Dill and Huston's Addition
<br /> in the City of Grand Island, T�Tebraska.
<br /> To have and to hold the above described premises, together with all tenements,
<br /> hereditaments, and appurtenances thereto belonging unto the Grantees and Grantees'
<br /> successors and assigns forever, provided and conditioned, that the City of Grand
<br /> Island reserves the south twelve (12) feet of the north one hundred twenty (120)
<br /> feet of the west twenty-five (25) feet of said vacated Beta Street to be used to
<br /> construct, operate, maintain, extend, repair, replace and remove sani.tary sewer
<br /> mains, overhead and underground el.ectric distribution lines, telephone lines,
<br /> manholes, and other appurtenances therefor in, upon, over, underneath, and through
<br /> said described easement area; and the east five (5) feet of the west twenty-five
<br /> (25) feet of the north one hundred twenty (120) feet of said vacated Beta Street,
<br /> to be used to construct, operate, maintain, extend, repair, replace, and remove
<br /> storm drainage lines, overhead and underground electric distribution lines, man-
<br /> holes, and other appurtenances therefor in, upon, over, underneath, and through
<br /> said described easement area, together with the right of ingress and egress through
<br /> and across the above mentioned two easement areas for the purpose of exercising
<br /> the rights herein gr-anted. No improvements, structures, or buildings of any kind
<br /> whatsoever shall be allowed in, upon, or over the easements herein retained, except
<br /> fences, sidewalks, and hardsurfaced driveways shall be allowed in, upon, or over �
<br /> the easements herein retained, pro.vided and conditioned that when said fences,
<br /> sidewalks, or hardsurfaced driveways need to be removed to service said utilities
<br /> they shall be removed and replaced at the property owners' expense, said portion
<br /> of vacated Beta Street and the public utility easements therein retained are as
<br /> shown on the attached plat marked Exhibit "A" attached hereto and incorporated
<br /> herein by reference, containing 3,000 square feet, more or less. �
<br /> IN WITNESS WHEREUF, the Grantor has caused its corporate seal to be affixed
<br /> and this instrument to be signed by the President of the Council and attested by
<br /> the City C1erk.
