<br /> THIS DEED made this 1� day of January, 1971, by and between Sam
<br /> KeYun, Executor under the Last Will and Testament of Elizabeth Kehm,
<br /> deceased, late of Grand Island, in the County of Hall, State of Nebraska,
<br /> pa�ty of the first part, and Claude Oldfather and Dorothy Oldfather, h�band
<br /> and v,�ife, as joint tenants and not as tenants in common, of Grand Island,
<br /> Hall County, Nebraska, parties of the second part;
<br /> WITNE5SETH, that the said party of the first part, the duly appoint-
<br /> ed, qualified, and acting. Executor of said Elizabeth KeYun, deceased,
<br /> under .her Last Will and Testament, which is of record in the County Court
<br /> of Hall County, Nebraska, by virtue of the power and authority granted
<br /> and conferred upon him under said Will, and in consideration of the sum
<br /> of NINETEEN HUNDRED DOLL.'�RS ($1,900.00) to him paid by the parties
<br /> of the second part, the receipt whereof is hereby confessed and acknosnr-
<br /> ledged, does by these presen ts, grant, bargain, sell, remise, release,
<br /> alien, convey, and conf irm unto the said parties of the second part,
<br /> as joint tenants and not as tenants in common, and to their heirs and
<br /> assigns forever, all of the following described tract, piece and parcel
<br /> of land situate, lying and being in the County of Hall and State of
<br /> Nebrask�, to-wit: �
<br /> Lot Three (3), Block One Hundred Forty Five (145) , of
<br /> Union Pacific Railway Company`s Second Addition to Grand
<br /> Island, Hall County, Nebraska, excepting the Easterly
<br /> 'I'wenty-Four (E24' ) feet thereof,
<br /> Together with all and sa.ngular the tenements, hereditaments and appurten-
<br /> ances thereunto belonging or in anywise appertaining and also all of the
<br /> estate, right, title, interest, property, possession, claim and demand
<br /> whatsoever, which the said Testatrix had in her lifetime, and at the time
<br /> of her decease, which the said party of the first part has by virtue of
<br /> the said Last Will and Testament, or otherwise, of, in or to the above
<br /> granted premises, and every part and parcel thereof with the appurtenances;
<br /> TO HAVE AND TO HOLD the said premises, the tract of land aforesaid,
<br /> with the hereditaments and appurtenances thereof, unto the said grantees
<br /> and to their heirs and assigns forever.
<br /> And the said party of the first part, Sam Kehm, for himself and 'h�:s
<br /> successors, his heirs, executors and admin��rators, covenants, promises
<br /> and agrees to and with the said parties of the second part that he is law=
<br /> fully the Executor of the Last Will and Testament of the said Elizabeth
<br /> Kehm, deceased; that he is lawfully seized of said premises; that said
<br /> premises are free from encumbrance and that he has power to convey as
<br /> af oresaid, and has in all respects acted, in making this conveyance,
<br /> in pursuance of the authority granted in and by the said Last Will and
<br /> Testament of the said Elizabeth Kehm, deceased, and that he has not
<br /> made, done, or suffered any act, matter or thing whatsoever, since he
<br /> was executor as aforesaid, whereby the above granted premises or any
<br /> part thereof, are, shall, or may be impeached, charged or encumbered in
<br /> any �manner whatsoever.
<br /> IN WITNESS WHEREOF .the said Sazn KeY�n, as Executor, has hereunto set
