<br /> . THIS DEED made and executed this �-� day of ,����:��.�_ ,
<br /> 1970, by and between JAMES W. VIEREGG, Executor of the La.st Will
<br /> and Testament of Eva Brass Vieregg, Deceased, late of Grand
<br /> Island, Hall County, Nebraska, Party of the First Part, and
<br /> BIG CREEK LAND AND CATTLE COMPANY, A Corporation, Party of the
<br /> Second Part,
<br /> W I T N E S S E T H:
<br /> That the Party of the First Part, being the duly appointed,
<br /> qualified, and acting Executor of the Estate of Eva Brass Vieregg,
<br /> Deceased, under her Last Will and Testament, which is of record
<br /> in the County Court of Hall County, Nebraska, under and by virtue
<br /> of the power and authority granted to him under such Will, and in
<br /> consideration of the sum of 'TW'ENTY THOUSAND DOLLARS ($20,000.00)
<br /> to him paid by the Party of the Second Part, receipt whereof is
<br /> hereby acknowledged, does, by these presents, grant, bargain,
<br /> sell, remise, release, convey, and confirm unto the Party of the
<br /> Second Part the following described real estate situate in the
<br /> County of Hall, State of Nebraska, to-wit:
<br /> Lot Six (6) in Block One Hundred 'I�a�nty-two (122) of
<br /> Koenig and Wiebers Addition to Grand Island, Hall
<br /> County, Nebraska,
<br /> together with all and singular the tenements, hereditaments and
<br /> appurtenances thereunto belonging or in any wise appertaining
<br /> thereto and also all of the estate, right, title, interest, '
<br /> property, possession, claim and demand whatsoever which the said .
<br /> Claus A. Tagge had in his lifetime and at the time of his death
<br /> and which the Party of the First Part has, by virtue of said Last
<br /> Will and Testament, or otherwise, of, in, or to the above granted
<br /> premises and every part and parcel thereof with .the appurtenances.
<br /> TO HAVE AND TO HOLD the above described premises together
<br /> with all tenements, hereditaments and appurtenances thereunto
<br /> , belonging unto the Second Party and to his heirs and assigns "
<br /> forever.
<br /> And I, JAMES W. VIEREGG, for myself, my heirs, executors and
<br /> � administrators do. covenant, promise and agree to and with the
<br /> Party of the Second Part that I am lawf.ully the Executor of
<br /> the Last Wi11 and `Testament of Eva Brass Vieregg, Deceased, and
<br /> that as such, I am lawfully seized of said premises, that said
<br /> premises are free from encumbrances, and that I have the power
<br /> to convey as aforesaid and have acted in making this conveyance
<br /> in pursuance of the authority granted in and by such Last Will
<br /> and Testament, and that I have not made, done or suffered any
<br /> act, matter, or. thing whatsoever as Executor whereby the above
<br /> granted premises or any part` thereof will, shall, or may be
<br /> impeached; charged or encumbered in any manner whatsoever.
