<br /> EXECUTOR'S DEED
<br /> THE OVERLAND NATIONAL BANK OF GRAND ISLAND, NEBRASKA, the duly
<br /> appointed, qualified and acting Executor of the Estate of Hollis B.
<br /> Mahoney, Deceased, as Executor of the Estate of Hollis B. Mahoney,
<br /> Deceased, and pursuant to authority granted it by the Last Will and
<br /> Testament of Hollis B. Mahoney, Deceased, in consideration of
<br /> SEVENTEEN THOUSAND SIX HUNDRED DOLLARS ($17,600.00) received from
<br /> Grantees, hereby grants, bargains, sells, conveys and confirms unto
<br /> MARION L. CODNER and LILLIAN D. CODNER, husband and wife, as joint
<br /> tenants and not as tenants in common, the following described real
<br /> estate situated in Hall County, Nebraska, to-wit:
<br /> Lot Thirteen (13) , Block Nine (9) , Parkhill Third
<br /> Subdivision, an Addition to the City of Grand Island,
<br /> Hall County, Nebraska, as surveyed, platted and
<br /> recorded,
<br /> together with all tenements, hereditaments and appurtenances thereto
<br /> belonging unto the Grantees as joint tenants , and all the estate,
<br /> right, title, interest, claim or .demand whatsoever of said Hollis B.
<br /> Mahoney, deceased (who took title to the real estate as Grantee in
<br /> the name of Hollis B. Clegg, by Warranty Deed dated March 16 , 1955,
<br /> filed of record in the Office of the Register of Deeds of Hall
<br /> , County, Nebraska, on March 17, 1955, recorded in Book 113 of Deeds ,
<br />;
<br /> at page 245) , the Testator, of, in and to the same, or any part
<br /> thereof.
<br /> The above-described real estate is conveyed and transferred
<br /> subject to the following:
<br /> 1. Agreement for Protective Covenants, Restrictions and Conditions
<br /> for "Parkhill Third Subdivision" , an Addition to the City of Grand
<br /> Island, Nebraska, filed of record on December 22, 1952, in the
<br /> Office of the Register of Deeds of Hall County, Nebraska, recorded
<br /> in Book X of Miscellaneous Records, at page 129; and
<br /> 2. All applicable zoning laws, rules, regulations and ordinances of
<br /> the City of Grand Island, Nebraska, and any other governmental
<br /> body having jurisdiction of zoning over the real estate.
<br /> TO HAVE AND TO HOLD the above-described premises unto the said
<br /> Marion L. Codner and Lillian D. Codner, husband and wife, as joint
<br /> tenants and not as tenants in common.
<br /> � The Overland National Bank of Grand Island, Nebraska, Executor
<br /> of the Estate and of the Last Will and Testament of Hollis B. Mahoney,
<br /> Deceased, hereby covenants that the premises are free and clear of any
<br /> lien or encumbrance caused by any claim for taxes levied against the
<br /> estate of Hollis B. Mahoney, deceased, and does hereby warrant that it
<br /> will defend the said premises against lawful claims and demands of all
<br /> persons claiming by, through or under it.
<br /> IN WITNESS WHEREOF, The Overland National Bank of Grand Island,
<br /> Nebraska, as Executor of the Estate and of the Last Will and Testament
