<br /> THIS DEED made this 2nd day of January, 1970, by and between Sam
<br /> Kehm, Executor under the Last Will and Testament of Elizabeth Kehm,
<br /> deceased, late of Grand Island, in the County of Hall, State of Nebraska,
<br /> party of the first part, and G1en.M. Stewart of Grand Island, Hall County,
<br /> Nebraska, party of the second part;
<br /> WITNESSETH, that the said party of the first part, the duly appoint-
<br /> ed qualified and acting Executor of said Elizabeth Kehm, deceased under
<br /> her Last Will and Testament, which is of record in the County Court of
<br /> Hall County, Nebraska, by virtue of the power and authority granted and
<br /> conferred upon him under said Will, and in consideration of the sum of
<br /> FIVE THOUSAND I?�LLARS ($5,000.00) to him paid by the party of the second
<br /> part, the receipt whereof is hereby confessed and acknowledged, does by
<br /> these presents, grant, bargain, sell, remise, release, alien, convey and
<br /> confirm unto the said party of the second part and to his heirs and
<br /> assigns forever, all of the following described tract, piece and parcel
<br /> of land situate, lying and being in the County of Hall and State of
<br /> Nebraska, to-wit:
<br /> � Lot Two (2) , in Block One Hundred Forty-Five (145) , Union
<br /> Pacific Railroad Addition to the City of Grand Island, Hall
<br /> County, Nebraska, according to the recorded plat thereof,
<br /> subject to restrictive covenants now of record;
<br /> Together with all and singular the tenements, hereditaments and appur-
<br /> tenances thereunto belonging or in anywise appertaining and also all of
<br /> the estate, right, title, interest, property, possession, claim and
<br /> demand whatsoever, which the said Testatrix had in her lifetime, and
<br /> at the time of her decease, and which the said party of the first part
<br /> has by virtue of the said Last Will and Testament, or otherwise, of,
<br /> in or to the above granted premises, and every part and parcel thereof
<br /> •with the appurtenances;
<br /> TO HAVE A,ND TO HOLD The sa.id premises, the tract of land aforesaid,
<br /> with the hereditaments and appurtenances thereof, unto the said grantee �
<br /> and to his heirs and assigns forever.
<br /> And the said party of the first part, Sam Kehm, for himself and his
<br /> successors, his heirs, executors and administrators, covenants, promises
<br /> and agrees to and with the said party of the second part that he is law-
<br /> fully �ha Executor of the Last Will and Testament of the said Elizabeth
<br /> Kehm, Deceased; that he is lawf ully seized of said premises; that said
<br /> premises are free from encumbrance and that he has po�vaer to convey as
<br /> . aforesaid, and has in all respects acted, in making this conveyance, in
<br /> pursuance of the authority granted in and by�e said Last Will and Testa-
<br /> ment of the said Elizabeth Kehm, 7�ceased, and that he has not made, done
<br /> or suffered any act, matter or thing whatsoever, since h� was executor
<br /> as aforesaid, whereby the above granted premises or any part thereof, are,
<br /> shall or may be impeached, c?zarged or encumbered in a ny manner whatsoever.
