THEODORA KIRKPATRICK, each in <br /> his and her own right and as spouse of the other, herein called <br /> the grantor whether one or more; in consideration of Sixty-Nine <br /> Thousand and NO/100 Dollars ($69,000.00) received from grantee, <br /> does grant, bargain, sell, convey and confirm unto CHAMPLIN <br /> PETROLEUM COMPANY, a Delaware corporation, herein called the <br /> , grantee whether one or more, the following described real pro- <br /> perty in Hall County, Nebraska: <br /> The Southeast Quarter (SE4) of Block Nine (9), Pleasant <br /> Home Subdivision, an Addition to the City of Grand <br /> Island, Nebraska, such tract having a frontage of One <br /> Hundred Forty Feet (140T ) on Locust Street and a front- <br /> age of One Hundred Thirty-T`wo Feet (1321) on Hedde <br /> � Street, <br /> TOGETHER WITH a non-exclusive easement over and across <br /> a triangular tract of land located in the Northeast <br /> Quarter (NE4) of said Block Nine (9), which tract is <br /> � described as follows : <br /> Beginning at a point on the east line of said <br /> Block Nine (9) said point being Eighty (80.0) <br /> feet south of the Northeast corner of said <br /> Block Nine (9) ; thence, continuing southerly <br /> ' along the east line of said Block Nine (9), a <br /> distance of Sixty (60.0) feet; thence westerly <br /> along a line thru the center of said Block <br /> Nine (9), a distance of Thirty-Two (32.0) feet; <br /> thence northeasterly, a distance of Sixty-Seven <br /> and Eight Tenths (67.8) feet to the place of <br /> beginning. <br /> Said non-exclusive easement shall be for driveway pur- <br /> poses and means of ingress or egress from Locust Street <br /> to the Southeast Quarter (SE4) of said Block, which use <br /> shall be in conjunction with the use of such area by the <br /> owners, assigns, successors in interest and invitees <br /> thereof of the remainder of said Block. This right of <br /> easement is in perpetuity and is a covenant running <br /> with the land and shall be binding upon and inure to the <br /> benefits of the parties, their heirs, personal represen- <br /> tatives, successors and assigns. <br /> As additional consideration for the grant of the within <br /> non-exclusive easement Champlin Petroleum Company binds <br /> itself and its successors in interest to improve such <br /> easement area by hard surfacing and to at a11 times main- <br /> tain such surface in good condition of repai.r. <br /> TO HAVE AND TO HOLD the above described premises together with <br /> all tenements, hereditaments and appurtenances thereto belongi�ng <br /> unto the grantee and to granteets assigns forever. <br /> , <br /> f �/� <br />
