<br /> WHEREAS, in an action of partition pending in the District Court of
<br /> Hall County, Nebraska, wherein Gladys G. Hoffman`Cox was plaintiff and
<br /> Lloyd R. Hoffman, Jr., and Geraldine E. Hoffman, husband and wife, were
<br /> defendants, being Case No. 16,657� for the partition of the premises herein- '
<br /> , after described, the undersigned referee� appointed bq said court to make
<br /> partition of 'said real estate� made report in writing, duly signed, setting
<br /> forth that partition of said lands could not be made without great prejudice
<br /> to the owners thereof, which report was duly examined by said court, and
<br /> said court,being satisfied therewith, confirmed the same and thereupon made
<br /> an order and caused the same to be e�tered, di,recting me as said referee to sell
<br /> said premises on the following terms, to-wit: To sell said premises at public
<br /> sale as upon execution at the lower level of the Gourthouse in Grand Island,
<br /> Ha11 County, Nebraska, the terms of sale being 15°ti eash on day of sale, baiance
<br /> on confirmation.
<br /> And in pursuance of said order 1 caused a notice to be published in
<br /> the Grand Island Daily Independent, a newspaper printed and in general circula-
<br /> tion in Hall County, Nebraska, that I would offer said premises for sale at
<br /> the lower level of the Courthouse in the City of Grand Island, Ha11 County.,
<br /> Nebraska� on the 25th day of April, 1969, at 1:30 o'clock P. M. of said day
<br /> and at the time and place stated in said notice, and after said notice had been
<br /> published for more than thirty days, I offered said premises, to-wit:
<br /> Lot Ten (10) in Blxk Twelve (12) in Coliege Addition to
<br /> West Lawn, in the City of Grand Island, Hall Gounty, Nebraska,
<br /> as surveyed, platted and recorded�
<br /> for sale at public auction and sold the same to Richard W. Bailey and Berniece
<br /> M. Bailey, hus.band and wife, and Lynwood F. Meyer and Marian M. Meyer, husband
<br /> and wife, for the sum of $245.00, they being the highest bidders therefor, and
<br /> afterwards, on the same date� said court approved and confirmed said sale
<br /> and by its order directed me, as said referee, to execute to said purchasers
<br /> ' a deed conveying said lands to them in fee simple.
<br /> NOW, THEREFORE, I, John Story, referee, in consideration of the premises
<br /> and the sum of $245.00 so bid and paid by said purchasers and by virtue of the *
<br /> powers vested in me by law, do by these pre�ents grant, sell and convey unto
<br /> Kichard W. Bailey and Berniece M. Bailey, husband and wife, as joint owners
<br /> with right o£ survivorship of an undivided one-half interest and not as tenants �
<br /> in common, and Lynwood F. Meyer and�Marian M. Meyer, husband and wife, ,as
<br /> ;joint owners with right o£ survivorship of an undivided one-half interest and
<br /> not as tenants in comwon, and to their heirs�and assigns, the real estate
