<br /> WHEREAS, in an action of partition pending in the District
<br /> Court of Hall County, Nebraska, wherein Clara �4. Willis, et al. ,
<br /> were plaintiffs, and Martha Anna Kostlan, et al. , were defendants,
<br /> Case No. 16080, the undersigned, Gtayer Grimminger, Referee, appointed
<br /> � by the District Court of Hall County, Nebraska., to make partition of
<br /> the following described real estate, to-wit:
<br /> The Northeast Quarter (NE�) of Section TYaenty-Six
<br /> (26) , Township Ztaelve (12) North, Range Ten (10)
<br /> West of the 6th P.M. in Hall County, Nebraska.,
<br /> made report in writing, auiy signed, setting forth that partition of
<br /> said real estate could not be made without great pre�udice to the
<br /> owners thereof, which report was duly examined by the District Court
<br /> of Hall County, Nebraska., and said Court being satisfied therewith
<br /> confirmed the same, and thereupon made an Order and caused the same
<br /> to be entered, directing the undersigned, G�ayer Grimminger, as
<br /> Referee, to sell the real estate on the following terms, to-wit:
<br /> The Referee proceed to se11 the real estate at public sale as upon
<br /> execution at the front door of the Hall County Courthouse in Grand
<br /> Island, Hall County, Nebraska, the terms of sale being fifteen per
<br /> cent cash and the balance upon confixmation.
<br /> In pursua.nce of the Order of the District Court of Hall
<br /> County, Nebraska, directing the sale of the real estate as above
<br /> des�ribed, the undersigned, (�ayer Grimminger, Referee, caused a
<br /> notice to be published in the Grand Island Daily Independent, a
<br /> newspaper printed and in general circulation in Hall County, Nebraska,
<br /> that the undersigned, G�ayer Grimminger, Referee, would offer said
<br /> real estate for sale at th� front door of the Ha11 County Courthouse,
<br /> in Grand Island, Nebraska, on September 11, 1967, at 2:00 p.m. of
<br /> said day, and at the time and place stated in the published legal
<br /> notice, and after said legal notice had been published for more than
<br /> thirty days, the undersigned, (�ayer Grimminger, Referee, offered the �
<br /> real estate described above for sale at public sale as upon execution
<br /> (being a public auction) and sold the above described real estate to
<br /> Lloyd Mader for the sum of $73,120.00, he being the highest bidder
<br /> � therefor.
<br /> On September 21, 1967, the undersigned, Gfayer Grimminger,
<br /> Referee, filed his RefereeTs Report of Sale in the District Court of
<br /> Ha11 County, Nebraska, in said partition proceedings, and plaintiffs
<br /> made an oxal Motion for Confirmation of Sale. Hearing on the
<br /> Refereets Repoxt of Sale and the plaintiffs ' Motion for Confirmation
<br /> of Sale was continued to October 9, 1967, . at 10:00 a.m.
<br /> On October 9, 1967, at 10:00 a.m. , the District Court of
<br /> Ha11 County, Nebxaska, permitted plaintiffs to withdraw their Motion
<br /> for Confirmation of Sale and found that the sale by the undersigned,
<br /> Gwyer Grimminger, Referee, ma.de at the public auction sale held on
<br /> September 11, 1967, should be set aside and sale of the real estate
<br /> reopened in court to permit further bidding. The Court offered the
<br /> land for sale in open court and sold the real estate to Lloyd Mader
<br /> for the sum of $80,000.00. The District Court of Hall County,
<br /> Nebraska, by its Judgment has approved and confirmed the sale of the
