<br /> We, August W. C. Niedfelt and Ella M. Niedfelt, each in his and
<br /> her awn right and as spouse of each other, herein called the grantor
<br /> whether one or more, in consideration of One Thousand Five Hundred
<br /> ($1,500.00)-----Dollars, received from grantees, does grant, bargain,
<br /> sell, convey and confirm unto Donald L, Cole and Edna M. Cole, spouse
<br /> of each other, as joint tenants with right of survivorship, and not as
<br /> tenants in common, the foll.owing described real property in Hall County
<br /> Nebraska;
<br /> A tract comprising a part of the Northeast Quarter of Section 35,
<br /> Township 11 North, Range 9, West of the 6th P.M,, more particula.rly
<br /> described as follows: Beginning at a point on the east line of
<br /> said Section 35 and 462.42 feet south of the northeast corner of
<br /> said Section 35; running thence south along and upon the east line
<br /> of said Section 35 a distance of 104.35 feets �unning thence west
<br /> and parallel to the north line of said Section 35 a distance of
<br /> 208.71 feetf running thence north and parallel to the east I.ine
<br /> of said Section 35 a distance of 104.35 feets running thence east
<br /> along and upon the south line of a tract conveyed by deed recorded
<br /> in Book 150 at page ��2 of the off icial deed records of Hall County,
<br /> Nebraska� for a distance of 208.71 feet to the point of beginningp
<br /> To have and to hold the ab�ve premises together with all tenements,
<br /> hereditaments and appurtenances thereto belonging unto the grantees and
<br /> to their assigns, or to the heirs and assigns of the survivor of them
<br /> forever.
<br /> And grantor does hereby covenant with the grantees ancl with their
<br /> assigns and with the heirs and assigns of the survivor of them that
<br /> grantor is lawfully seised of said premisest that they are free from
<br /> encumbrance but this , conveyance is made subject to county road and
<br /> easements of record; that grantor has good right and lawful authority
<br /> to convey the saznei and that grantor warrants and will defend the title
<br /> to said premises agair�t the lawful claims of all persons whomsoever.
<br /> Grantees covenant for themsalves and their successors in title
<br /> that said premises will be used for residential purposes only and that
<br /> no temporary or trailer homes and no commercial activities will b�
<br /> placed or permitted on said premisess thes.e restrictive covenants run
<br /> with the land and are for the benefit of the grantors and their per-
<br /> sonal representatives, heirs-at-law, devisees, and assigns.
<br /> It is the intention of all parties hereto that in the event of the
<br /> death of either of the grantees, the entire f ee simple title to the
<br /> real estate shall vest in the surviving grantee.
