<br /> ; ,
<br /> KNOW ALL M�N BY THESE PRESENTS THAT:
<br /> WHEREAS, in an action of Partition pending in the District Court of
<br /> Ha11 �County', Nebraska, wherein Dee Anne Fairbanks, a minor, and Donald Lindsay
<br /> Fairbanks, a minor, by Margaret F. Newsum, their mother and next friend, were
<br /> Plaintiffs, and Joan E. Rockwood and Tohn E. Rockwood, .her husband, Ruth Johnson
<br /> and Charles Johnson, her husband, Marlin Kroger and Delores Kroger, his wife,
<br /> Wilbur Kroger and Betie Sue Kroger, his wife, Eva Bailey and Tom W. Bailey, her
<br /> husband, Arlene Krivohlavek, James T. Townsend, and L1oyd Hoover, were Defendants,
<br /> for the Partition of the premises hereinafter described, the undersigned RefePee,
<br /> ', appointed by said Court to make Partition of the said real estate, made report in
<br /> writing, duly signed, setting forth the partition of said land could not be made
<br /> without great prejudice of the owners thereof, which report was duly examined by
<br /> said Court, and said Court being satisfied therewith, confirmed the same, and
<br /> thereupon made an order and caused the same to be entered, directing me as said
<br /> Referee to sell said premises on the following terms, to-wit: Fifteen per cent
<br /> (15%) cash on day of sale and the balance remainder on confirmation by the Court.
<br /> AND, In pursuance of said Order, I caused a Notice to be pubiished in
<br /> the ��Grand Island Daily Indendent,�� a newspaper printed and in general circulation
<br /> in Hall County, Nebraska, that I would offer said land for sale on the ground floor
<br /> of the Hall County Courthouse, in Grand Island, lHa11 County, Nebraska, on the
<br /> llth day of January, 1967, at 2:00 p.m., of said day, and at the time and place
<br /> stated in said Notice, and after said Notice had been published for more than
<br /> thirty (30) days, I offered said land, to-wit:
<br /> Lot Five (5) in B1ock Twenty-eight (28) in Charles Wasmer�s Addition
<br /> to the City of Grand Island, Nebraska, as surveyed, platted and recorded,
<br /> � for sale at Public Auction, and sold the same to Barhara D. Weaver of Grand Island,
<br /> Nebraska, for the sum of $7,000.00, said Barbara D. Weaver, being the highest
<br /> bidder therefore. And afterwards, on the 20th da;- of January, 1967, said Court
<br /> i approved and confirmed said sale, and by an Order directed me as said Referee to
<br /> execute to said Barbara D. Weaver, a Deed conveying said land to Barbara D. Weaver.
<br /> NOW, THEREFORE, I, RICHARD L. WALDRON, Referee, in considera�ion of the
<br /> premises in the sum of $7,000.00 bid and paid by the said Bar�ara D. Weaver, and
<br /> by the virtue of the powers vested in me by law, do by these presents grant, sell
<br /> and convey unto the said Barbara D. Weaver, the following described real property
<br /> in Hall County, Nebraska, to-wit:
<br /> Lot Five (5) in Block Twenty-eight (28) in Charles Wasmer�s Addition
<br /> to the City of Grand Island; Nebraska, as surveyed, platted and recorded,
<br /> To have and to hold the above-described premises, together with a11 the tenements,
<br /> hereditaments and appurtenances thereto belonging, unto the Grantee, and to her
<br /> assigns, or to the heirs and assigns of her.
