<br /> WALDEMAR H, LAMBREGHT AND MAXINE W, LAMBRECHT, husband and wife,
<br /> each in his or her own right and as spouse of the other, herein called
<br /> the grantor whether one or more, in consideration of One Dollar ($1.00)
<br /> and other valuable consideration, received from grantees, does grant,
<br /> bargain, sell, convey, and confirm unto ORVILLE M. LEWIS AND ROSE LEWIS,
<br /> husband and wife, as joint tenants with right of survivorship, and not as
<br /> tenants in common, the following described real property in Hall County,
<br /> Nebraska:
<br /> A part of Lot Six (6) in Section Seventeen (17), Township Nine (9), North,
<br /> Range Eleven (11) West, described as follows: A certain tract, piece or
<br /> parcel of land, containing 9 acres, more or less, commonly known as a "Tow-
<br /> Head," or Island in the Platte River, being unsurveyed land, and located
<br /> North of the shore line of Lots 6, 7, 8, and 9, in Section Seventeen (17),
<br /> Township Nine (9), North, Range Eleven (11), West of the 6th P.M. in Hall
<br /> County, Nebraska, more particularly described as lying between the shore
<br /> line and the South side of the center thread of the North Channel of the
<br /> Platte River, and being designated under the law as Being a part of Lot
<br /> Six (6) in Section Seventeen (17), Township Nine (9) North, Range Eleven
<br /> (11) West, in Hall County, Nebraska.
<br /> -That said piece or parcel of land being the property of said Waldemar H.
<br /> Lambrecht and Maxine W. Lambrecht, husband and wife, by virtue of the laws
<br /> of the State of Nebraska, whe�ein Islands or "Tow-Heads" unsurveyed ly-
<br /> ing between the shore line and the center thread of non-navigable rivers,
<br /> following and become a part of the land lying along the shore line. That
<br /> said Waldemar H. Lambrecht and Maxine W. Lambrecht, are the owners of the
<br /> land herein described and they are the owners by virtue of a deed from
<br /> Ralph Colgan and Viola Colgan, each in their own right and as spouse of
<br /> the other, and by virtue of said ownership, the said Waldemar H. Lam-
<br /> brecht and Maxine W. Lambrecht, warrant the title to .said premises against
<br /> the lawful claims of al1 persons whomsoever to the extent only, that is to
<br /> say, that in case the claim of the grantee shall at any time fail on ac-
<br /> count of any paramount title in any person whomsoever, then the said Wal-
<br /> demar H. Lambrecht and Maxine W. Lambrecht, agree to repay to Orville M.
<br /> Lewis, the sum of $ 3500.00 , without interest and no more, and not
<br /> then until the said grantee has been ejected by some person or persons hav-
<br /> ing a paramount title.
<br /> To have and to hold the above described premises together with all
<br /> tenements, hereditaments and appurtenances thereto belonging unto the
<br /> grantees and to their assigns, or to the heirs and assigns of the survivor
<br /> of them forever.
<br /> And grantor does hereby covenant with th� grantees and with their
<br /> assigns and with the heirs and assigns of the survivor of them that grantox
<br /> is lawfully seised of said premises; that they are free from encumbrance,
<br /> no exceptions; that grantor has good right and lawful authority to convey
<br /> the same; and that grantor war�ants and will defend the title to said prem-
<br /> ises against the lawful claims of all persons whomsoever.
<br /> It is the intention of a11 parties hereto that in the event of the
<br /> death of either of the grantees, the entire fee simple title to the real
<br /> estate shall vest in the surviving grantee. � .
