<br /> WHEREAS, in an action of partition pending in the District �ourt
<br /> of Hall County, Nebraska wherein Fay A. Stewart and Peggy Stewart,
<br /> husband and wife, were plaintiffs, and Glen M. Stewart, Guardian of
<br /> Florence F. Stewart, et als. , were defendants, being Case N o. 15890,
<br /> for the partition of the premises hereinafter described, the under-
<br /> signed referee, appointed by said court to make partition of said
<br /> real estate, made report in writing, duly signed, setting forth that
<br /> partition of said lands could not be made without great prejudice to
<br /> the owners thereof, which report was duly examined by said court, and
<br /> said court being satisfied therewith confirmed the same, and thereupon
<br /> made an order and caused the same to be entered, directing me as said
<br /> referee to sell said premises at public sale.
<br /> Pursuant to said order I caused a notice to be published in the
<br /> Grand Island Daily Independent, a newspaper printed and in general
<br /> circulation in Hall County, Nebraska, that I would offer said premises �
<br /> for sale at the court house in said county on the 6th day of January,
<br /> 1967 at 2:00 o' clock p.m. of said day, and at the time and place stated
<br /> in said notice, and after said notice had been published for more than
<br /> thirty days, I offered said premises, to-wit:
<br /> A tract of land in the Northwest Quarter of the Northeast
<br /> Quarter (NW%aNF�4) , Section Twenty Nine (29) , Township Eleven
<br /> (11) , Range Nine (9) , West of the Sixth (6th) P.M. , Hall
<br /> County, Nebraska, described ass Beginning at a point Thirty-,
<br /> Three (33) Feet West and Five Hundred Eleven (511) Feet
<br /> South of the Northeast (NE) corner of such Noxthwest Quarter °
<br /> of the Northeast Quarter (NW�aN 'F�'a) , thence running Westerly _ _ .
<br /> and parallel to the N orth line of such Northwest Quarter of
<br /> the Northeast Quarter (NW�4N�) , a distance of One Hundred
<br /> Seventy (170) Feet; thence Northerly and parallel to the
<br /> East boundary of such section, a distance of Seventy-Eight
<br /> (78) Feet; tYience Easterly and parallel to the North boundary
<br /> of such Northwest Quarter of the Northeast Quarter (N�NF�) ,
<br /> a distance of One Hundred Seventy (170.) Feet, thence Southerly
<br /> and parallel to the East line of such Northw�st Quarter of
<br /> the Northeast Quarter (N4$�4N 'F}�a) , a distance of Seventy-Eight
<br /> (78) Feet to the point of beginning, subject to easements
<br /> of record, said tract of land including a part of Lot Five
<br /> (5) , Block Two (2) , Stewart Place Subdivision, Hall County,

<br /> for sale at public auction and received the bids of E. J. ,Vacl.avek and
<br /> Edward A. Jeffrey, and reported the same to said court for instructions.
<br /> Afterwards, on the 30th day of January, 1967, hearing was had by said
<br /> court and the said two bidders given the opportunity to increase their
