<br /> EXECUTRIX DEED
<br /> THIS DEED made this ,,,�� day of November, 1966, by and between Norma
<br /> Emery of Grand Isiand, in the County of Hall and State of Nebraska, Executrix
<br /> of the Last Will and Testament, of Louise Emery, deceased, late of Grand Island,
<br /> in the County of Hall, State of Nebraska, party of the first part, and Lewis C.
<br /> Emery and Carolyn A. Emery, husband and wife, of Grand Island, in the County of
<br /> Hall, State of Nebraska, party of the second part.
<br /> WITNESSETH that the said party of the first part, the duly appointed,
<br /> qualified and acting Executrix of the estate of Louise Emery, deceased, under
<br /> her Last Will and Testament which is of record in the office of the County Court
<br /> of Hall County, Nebraska, by virtue of the power and authority, granted and con-
<br /> ferred upon her, under said will, and in consideration of the sum of TEN THOUSAND
<br /> DOLLARS ($10,000) to her paid by the party of the second part, the receipt whereof
<br /> is hereby acknowledged, does by these presents grant, bargain, sell, remise, rel-
<br /> ease, convey and confirm unto the said party of the second part, and to their
<br /> heirs and assigns forever, ail the following described tract of land, situated
<br /> in the County of Hall and State of Nebraska, to-wit:
<br /> The Easterly Sixty-one (61) feet of Lot Eight (8}, in Block
<br /> Fourteen (14) in Arnold and Abbott's Addition ta the City of
<br /> Grand Island, Nebraska
<br /> together with all and singular the tenements, hereditaments and appurtenances
<br /> thereunto belonging or in anywise appertaining; and also all the estate, right,
<br /> title, interest, property, possession, claim and demand whatsoever, which the
<br /> said Testatrix had in her lifetime, and at the time of her demise and which
<br /> the said party of the first part has, by virtue of the said Last lNill and Testa-
<br /> ment, of, in, or to the above granted premises, and every part and parcel thereof
<br /> with the appurtenances. To have and to hold the said premises, aforesaid, with
<br /> the hereditaments and appurtenances thereof, unto the said party of the second
<br /> part, their heirs, and assigns, forever.
<br /> And the said party of the first part, for herself, he� heirs, execu-
<br /> tors and administrators, does covenant, promise and undertake to and with the
<br /> said party of the second part, their heirs and assigns, that she is lawfully
<br /> the Executrix of the Last Will and Testament of said Louise Emery, and has power
<br /> to convey as aforesaid, and has in all respects acted, in making this conveyance
<br /> in pursuance of the authority granted in and by the said Last Will and Testament;
<br /> and that �e has not made, done or suffered any act, matter or things whatsoever
<br /> since she was Executrix as aforesaid whereby the above granted premises, or any
<br /> part thereof, are, shall or may be impeached, charged or incumbered, in any man-
<br /> ner whatsoever.
<br /> IT IS THE INTENTION OF ALL PARTIES HERETO THAT IN THE EVENT OF THE DEATH
<br /> OF EITHER OF THE GRANTEES, THE ENTIRE FEE SIMF�LE TITLE TO THE REAL ESTATE SHALL
<br /> VEST IN THE SURVIVING GRANTEE.
