<br /> THAT WHEREA�, in an action of partition pending in t e.DiStrict' ourt
<br /> of Ha11 Gounty, Nebraska, wlierein Margaret Williams and Dan Williams
<br /> are •plaintiffs and.Warren Anthony Williams, et al are defendants for the
<br /> partition of the premises hereinafter de.scribed, the'undersigned Referee
<br /> appointed by said court to make partition of said real estate, made report
<br /> in writing duly signed setting forth that partition of, said lands could
<br /> not be made without great pre�udice to the owners thereof, which report
<br /> was duly examined by the court, and the court bei;ng satisfied therewith,
<br /> app,roved and confirmed the same and ordered the same to be entered of
<br /> Tecord and directed me as; said Referee to sell said premises for cash,
<br /> fifteen percent down on the day of sale and the balance on confirmation
<br /> of �he sale, and+ directed me as said Referee that such sale to take place
<br /> at the front door of the Courthouse in Grand Island, Hall County, Nebraska
<br /> and in pursuance of said order, I caused notices to be published in the
<br /> Grand Island Daily Independent, a legal newspaper, printed and in general
<br /> circulation in Hall County, r?ebraska, ,that I would offer the real estate
<br /> hereinafter described for sale at the front door of the Courthouse., Grand
<br /> Island, Hall County, Nebraska, on the 20th day of June, 1966 at the hour
<br /> of 10:00 o'clock A.M. of said day, and at the time and place sta�ted in
<br /> said notices, and after said notices had been published for more than
<br /> ttiirty days, I offered said land for sale at public auction and sold the
<br /> same to Emer A. Jacobsen and Rose Ann Jacobsen, husband and wife, for
<br /> the sum of Seven Thousand Five Hundred Fifty Dollars 4$7,550.00), they
<br /> being the highest bidderstherefore, and afterwards on the 5th day of
<br /> August, 1966, said court approved and confirmed said sale, and by an
<br /> order directed me as Referee to,execute to the said Elmer A. Jacobsen
<br /> and Rose Ann Jacobsen, husband and wife,1 a deed conveying said lands
<br /> to them in fee simplez
<br /> NOW THEReFORE, I, Richard �. Huebner, Referee, in consideration of the
<br /> premises and the sum of Seven Thousand Five Hundred Fifty Dollars
<br /> ($7,550.00), so bid and paid, by the said Elmer A. Jacobsen and Rose
<br /> Ann Jacobsen, husband and wife, and by virtue of the powers irested in '
<br /> � me by law, do by these presents grant, seli and convey unto the said
<br /> Elmer A. Jacobsen and Rose Ann Jacobsen, husband and wife, as joint
<br /> tenants with right of survivorship, and not as tenants in common, the
<br /> � following described real property in Hall County, Nebraska, to-wit:
<br /> Lot Ten, Block Eighty-eight, in Wheelera£� Bennett's
<br /> Fourth Addition to the City of Grand Island, Hall
<br /> County, Nebraska.
<br /> To have and to hoid the above described premises together with all the
<br /> tenements, hereditaments and appurtenances thereto belonging unto the
<br /> grantees and to their assigns, or to the heirs and assigns of the survivor
<br /> of them forever.
<br /> It is the intention of a11 parties hereto that in the event of the death of
<br /> either of the grantees, the entire fee simpie title to the real estate shall
<br /> vest in the surviving grantee.
