J. O�Connor, her husband, were <br /> plaintiffs and Walter Gleason, Catherine Watson, B. J. Cunningham (as Guardian <br /> for Catherine Watson, Incompetent) George Kroeger and E. Merle Mc Dermott (as <br /> Administrator of the Estate of Annetta Smith, deceased) were defendants for the <br /> partition of the premises hereinafter described, the undersigned referee, appointed <br /> by said Court to make partition of said real estate, made report in writing, duly <br /> ` signed, setting forth that partition of said lands could not be made without great <br /> 3 prejudice to the owners thereof, which report was duly examined by said Court, and <br /> said C.ourt being satisfied therewith, confirmed the same, and thereupon made an <br /> Order and caused the same to be entered, directing me as said referee to sell said <br /> jpremises on the following terms, to-wit: Fifteen per cent cash on day of sale <br /> and the balance and remainder on confirmation by the Court. <br /> And in pursuance of said Order I caused a notice to be published in <br /> the ��Grand Island Daily Independent,�� a newspaper printed and in general circulation <br /> in Hall County, that I would offer said lands for sale on the ground floor of the <br /> Ha11 County Courthouse, in Grand Island, Ha11 County, Nebraska, on the 9th day of <br /> August, 1966, at 2:00 o�clock p.m. of said day, and at the time and place stated <br /> in said notice, and after said notice had been published for more than thirty <br /> days I offered said lands, to-wit: <br /> Lot Seven (7) in Block Fifteen (15) of Schimmer�s Addition ' <br /> to the City of Grand Island, in Hall County, Nebraska, as <br /> surveyed, platted and recorded, <br /> for sale at public auction, and sold the same to William' C. Unzicker and Lelia B. <br /> ' Unzicker, husband and wife, as joint tenants with right of survivorship, of Grand <br /> Island, Nebraska, for the sum of $8,750.00, said persons being the highest bidders <br /> therefor. And afterwards, on the 6th day of September, 1966, said Court approved <br /> and confirmed said sa1e, and by an order dorected me as said refereee to execute <br /> to said William C. Unzicker and Lelia B. Unzicker, a deed conve�i�g��said:lands to <br /> them in fee simple and in accordance with the terms upon which said land was <br /> offered for sale 'at said auction. <br /> NOW, THEREFORE, I, Lloyd W. Kelly, Jr., referee, in consideration of <br /> the premises and the sum of $8,750.00 so bid and paid by said William C. Unzicker <br /> and Lelia B. Unzicker, and by virtue of the powers vested in me by law, do by <br /> these presents grant, sell, and convey unto the said William C. Unzicker and Lelia.B. <br /> Unzicker, husband and wife, as joint tenants with right of survivorship and not as <br /> tenants in common, and to their heirs and assigns the real estate described as <br /> follows: <br /> Lot Seven (7) in Block Fifteen (15) of Schimmer�s Addition <br /> to the City .of Grand Island, in Ha11 County, Nebraska, as <br /> surveyed, platted and recorded, _ . <br /> with all the appurtenances thereunto belonging, to have and to hold �he same to <br /> them, the said William C. Unzicker and Lelia B.
