<br /> KNOW ALL MEN BY THESE PRESENTS:
<br /> That wh.ereas, in an action of Partition pending in the
<br /> District Cc�rt of Hall County, Nebraska, wherein Ralph Dibbern
<br /> and Evelyn Dibbern, his wife; Ella Hetrick, single; John Dibbern
<br /> and Nancy Dibbern, his wife are Plaintiffs and William Dibbern,
<br /> single, a minor; Pamela Dibbern, single, a minor; and Sally
<br /> Dibbern, single, a minor are Defendants, for the partition of the
<br /> premises hereinafter described, the undersigned Referee, duly
<br /> appointed by said Court to make partition of said real estate,
<br /> made report in writing, duly signed, setting forth that partition
<br /> of said real estate could not be made without great prejudice to
<br /> the owners thereof, which report was duly examined by the Court,
<br /> and said Court, bei.ng satisfied fherewith, confirmed the same,
<br /> and thereupon made an order directing the undersigned Referee to
<br /> sell said premises on the following terms, to-wit: 20�/o cash and
<br /> the balance upon confirmation.
<br /> In pursuance of said order, the undersigned Referee, after
<br /> giving bond and taking the oath required by law, caused a
<br /> notice to be published in the Grand Island Daily Independent,
<br /> a newspaper printed and in general circulation in Hall County,
<br /> Nebraska, that said Referee would offer said real estate for
<br /> sale in the main corridor of the Court House in said Colir.ty and
<br /> state on the .20th day of June, 196�, at 2:00 P. M. of sa�-d day,
<br /> and at the time and place stated in said notice, and after said
<br /> notice had been published for more than thirty days, such real
<br /> estate, to-wit:
<br /> The West Half (W2) of Lot Two (2) and all of Lot
<br /> Three (3), in Block Two (2), in Dodd & Marshall's
<br /> Addition to the Village of Wood River, Nebraska,
<br /> was offered for sale at public auction and sold to Ralph Dibbern,
<br /> Ella Hetrick, and John Dibbern for the suzn of Twenty-four Hundred
<br /> Dollars (�2,400.00), they being the highest bidder"s therefor, ,
<br /> and afterwards on the 27th day of June, 1961, I reported said
<br /> sale to the Court, and on the said 27th day of June, 1961, said �
<br /> Court approyed and confirmed said sale and ordered and directed
<br /> the undersic�ned, Referee to execute and deliver to Ralph Dibbern,
<br /> Ella Hetrick, and John i�ibbern a deed conveying such real estate
<br /> to them.
<br /> NOW THEREFORE, I, James 1. Shamberg, Referee, in consideration
<br /> of the sum of Twenty-four Hundred Dollars (�2,400.00) so�bid and
<br /> paid, and by virtue of the power vested in m.e 1�y law, do sell,
<br /> vest and grant unto Ralph Dibbern, E11a Hetrick and John Dibbern
<br /> the following described real: estate, to-witc
<br /> The West Half (W�) of Lot Two (2) and all of Lot
<br /> Three (3), in Block Two (2), in Dodd & Marshall's Add-
<br /> ition to the Village of Wood Riv�r, Nebraska,
<br /> together with all the appurtenances thereunto belonging.
<br /> TO HAVE AN� TO HOLD the above described premises with the
<br /> appurtenances unto said .Grantees and to their heirs and assigns
<br /> forev�r.
