<br /> THIS DEED, made this 2nd day of April, 1965, by and between Arthur
<br /> C. Mayer, Executor under the Last Will and Testament and Codicil there-
<br /> to of Susie Phifer, deceased, late of Grand Island, Hall County,
<br /> Nebraska, Grantor, and Antonio Ortiz and Maria Ortiz, husband and wife
<br /> as joint tenants and not as tenants in common, Grantees, both of Grand
<br /> Island, Hall County, Nebraska;
<br /> WITNESSETH: That the Grantor, the duly appointed, qualified and
<br /> acting executor under the last will and testament of Susie Pl:ifer,
<br /> deceased, which is of record in the County Court of Hall County, Neb-
<br /> raska, by virtue of the power and authority granted and conferred upon
<br /> him under said will and in consideration of the sum of Seven Thousand
<br /> Seven Hundred Fifty Dollars ($7,750.00) , to him paid by Grantees, the
<br /> receipt whereof is hereby acknowledged, does by these presents grant,
<br /> bargain, se11, remise, release and convey unto the said Grantees, as
<br /> joint tenants with full right of survivorship as between them and not
<br /> as tenants in common, and to their assigns , or to the heirs and assians
<br /> of the survivor of them, forever, the following described premises : J
<br /> Lot Four (4) , in Block Thirteen ( 13 `, in Russel
<br /> ' � Wheeler's Addition to the City of Grand Island,

<br />� � time, and at the time of her decease, and which the said
<br /> ;� Grantor has by virtue of the said Last Will and Testamenz, or otner-

<br />� IT BEING THE INTENTION OF ALL PARTIES HERETO, THAT IN TZI-E EVENT

<br />� TC THE REAL ESTATE DESCRIBED HEREIN SHALL VEST IN THE SURVIVING GRANTEE,

<br />� with the hereditaments and appurtenances thereof, unto the said grantees
<br />� o as joint tenants, and not as tenants in common, and to their assions ,

<br />� �� And the said Grantor for himself and his successors, his heirs ,
<br />� .� executors and administrators, covenants, promises and aarees to and
<br /> y with• the said Grantees that he is the duly appointed, qualified and act-
<br /> � ing executor under the last will and testament and codicil thereto of
<br /> Susie Phifer, deceased; that he is lawfully seized of said premises ;
<br />`� that said premises are free from encumbrances and that he has power
<br />� to convey under said last will and testament and has in all respects
<br />� acted in making th.is conveyance in pursuance of the authority grant-
<br />,� ed in and by the said last will and testament and codicil thereto of
<br />•� Susie Phifer, deceased, and that he has not made, done or suffered
<br />,� any act, matter or thing whatsoever, since he was appointed executor
<br /> as aforesaid, whereby the above granted premises or any part thereof
<br />,o are, shall or may be impeached, charged or encumbered in any manner
