<br /> THIS DEED, made this � L��day of November, 1964, by and between Arthur
<br /> C. Mayer of Grand Island, Hall County, Nebraska , Executor under the Last
<br /> Will and Testament of Pearl A. Bishop, Deceased, late of Grand Island, Hall �
<br /> County, Nebraska , party of the first part, and Howard N. Kelley and Lois
<br /> G. Kelley, spouse of each other, as joint tenants, of Grand Island, Hall
<br /> County, Nebraska, parties of the second part:
<br /> VJITNESSETH, that said party of the first part, the duly appointed,
<br /> qualified and acting Executor under the Last Will and Testament of Pearl
<br /> A. Bishop, Deceased, which is of record in the office of the County Court
<br /> of Hall County, Nebraska, by virtue of the power and authority granted to
<br /> him under said Will, and in consideration of the sum of Eight Thousand
<br /> Dollars ($8,000.00) to him paid by the parties of the second part, the
<br /> receipt whereof is hereby acknowledged, does hereby bargain, sell, con-
<br /> vey and confirm unto the said parties of the second part, as joint tenants ,
<br /> and to their assigns and to the heirs and assigns of the survivor as
<br /> between them, forever, the following described real estate, to-wit:
<br /> Lot Ten (10) , in Block Fourteen (14) , in Gilbert 's Addition
<br /> to the City of Grand Island, Nebraska,
<br /> together with all and singular the tenements , hereditaments and appurten-
<br /> ances unto the same belonging or otherwise appertai_ning ; and also all the
<br /> estate, right, title, interest, property, possession, claim and demand
<br /> whatsoever, which the said Testatrix had in her lifetime, and at the time
<br /> of her decease, and which the sa�.d party of the first part has by virtue
<br /> of the said Last Will and Testament or otherwise, of, in or to the above
<br /> described premises , and every part or parcel thereof with appurtenances .
<br /> TO HAVE AND TO HOLD the said premises aforesaid with the hereditaments
<br /> and appurtenances thereof, unto the said parties of the second part as
<br /> joint tenants and not as tenants in common, and to their assigns or to the
<br /> heirs and assigns of the survivor of them forever; it being the intention
<br /> of all parties hereto that in the event of the death of either of said
<br /> grantees, the entire fee simple title to the real estate described herein
<br /> shall vest in the surviving grantee,
<br /> And the said party of the first part, for himself, his heirs , execu-
<br /> tors and administrators , does covenant, promise and undertake to and with
<br /> the said parties of the second part, their assigns and the heirs and assigns
<br /> of the survivor of them, that he is lawfully the Executor under the Last
<br /> Will and Testament of said Pearl A. Bishop, Deceased, and has power to
<br /> convey as aforesaid, and has in all r2spects acted in making this convey-
<br /> ance, in pursuance of the authority granted in and by the said Last Will
<br /> and Testament of Pearl A . Bishop, Deceased ; that he has not made, done or
<br /> suffered any act, matter or thing whatsoever, since he was Executor as
<br /> aforesaid, whereby the above granted premises , or any part thereof, are , shall
<br /> or may be impeached, charged or encumbered in any manner whatsoever and that
<br /> he is lawfully seized of said premises ,
<br /> IN vVITNESS WHEREOF, the said party of the first part has hereunto set
