Richardson, currently residing at 113 Apple Lane, Doniphan, <br />Nebraska, am the owner of record of Lot 8(Eight) of the Leisure Valley Lake Subdivision, Ha11 J� 5� <br />County, Nebraska, hereafter referred to as "Grantor"; <br />WHEREAS, the Leisure Va11ey Lake Subdivision, is a rural housing subdivision loca.ted <br />in Ha11 CounTy and consists of twenty-one residential lots as originally platted, and one lake lot <br />(Lot 22), which under the covenants of the Leisure Va11ey Lake Subdivision is reserved for the <br />"common use" and enjoyment by a11 owners of record of Lots 1(One) through 21 (Twenty-one) <br />of said subdivision, hereafter referred to as "Grantees" ; <br />WHEREAS, it is the desire of residents of the Leisure Valley Lake Subdivision to install <br />a water pump aera.tion system in the Leisure Va11ey Lake, (Lot 22,) for purposes of rehabilita.ting <br />and improving the water and water quality of the lake; <br />WHEREAS, Grantees desire to have ingress and egress access to the Leisure Va11ey Lake <br />(Lot 22) over an esta.blished easement located on Lot 8(Eight) for purposes of installing the <br />aeration system and maintaining it; and <br />WHEREAS, Grantor is willing to grant to Grantees each individually and collectively an <br />easement over Lot �(Eight) for purposes of installing and maintaing an aeration system. <br />NOW, T`I-iEREFORE, for valuable consideration the receipt and adequacy of which is <br />hereby acknowledged, Grantor does hereby grant and convey unto Grantees and to Grantees' <br />invitees, agents, employers, heirs, successors and assigns, a permanent easement on Lot 8(eight) <br />over a 10 (ten) foot wide piece of land running along the easterly side of the property line <br />dividing Lot 7(seven) and Lot 8(eight) of the Leisure Va11ey Lake Subdivision from the Apple <br />Lane cul-de-sac to the Leisure Va11ey Lake (Lot 22) solely foY the purpose of installing, <br />maintaining and servicing a water aeration system for Lot 22, and for no other puppose. <br />The easement as granted herein sha11 be a perpetual easement and shall run with the land <br />and sha11 be binding upon and shall inure to the benefit of the parties hereto, their invitees, <br />agents, employers, heirs, successors and assigns, and all parties claiming ownership of Lots 1 <br />through 21 of the Leisure Va11ey Lake Subdivision. <br />Dated this � day of �� ��� �y �� , 2012. <br />� <br />ohn A.
