<br /> ` THIS DEED, made this o'� day of May, 1964, by and between
<br /> LEO F. THELEN, of Wood River, Hall County, Nebraska, Executor of th e
<br /> Zast Will and Testament of Katherine A. Finan, Deceased, being one
<br /> and the same person as the Catherine Finan, one of the Grantees in �
<br /> a certain Warranty Deed dated July 22, 1925, recorded in the office
<br /> of the Register of Deeds of Hall County, Nebraska, on July 2$, 1925 ,
<br /> in Book 66 of Deeds .at Page 31�0, late of Wood River, Hall County,
<br /> Nebraska, Party of the First Part, and HOWARD W. LOWELL and FRANCES '
<br /> E. LOWELL, ,husband and wife, as joint tenants and not as tenants in
<br /> common, of Wood River, Hall County, Nebraska, Parties of the Second
<br /> Part:
<br /> VdITNESSETH: That the said Party of the First Part, Leo F.
<br /> Thelen, the duly. appointed, qualified and acting Executor of said
<br /> Katherine A. Finan, Deceased, under her Last Will and Testament,
<br /> which is of record in the office of the County Court of Hall County,
<br /> Nebraska, by virtue of the power and authority granted and conferred
<br /> upon him, under the said Last Will and Testament, and in consideration
<br /> of the sum of Six Thousand and No/100 Dollars ($6,000.00) to him paid
<br /> by the Parties of the Second Part, the xeceipt whereof is hereby
<br /> conf'essed and acknowledged, does by these presents grant, bargain,
<br /> ! sell, alien, remise, release, convey and confirm unto the said Parties
<br /> of the Second Part, Howard W. Lowell and Frances E. Lowell, husband
<br /> and wife, as joint tenants and not as tenants in common, the following
<br /> described real estate situated in Hall County, Nebraska, to-wit :
<br /> Lot Six (6) in Block ttET' in MacColl 8c Leflangfs Second
<br /> Addition to Wood River, .Hall County, Nebraska,
<br /> together with all and singular the tenements, hereditaments and
<br /> appurtenances thereto belonging or in anywise appertaining; and also
<br /> all the estate, right, title, interest, property, possession, claim
<br /> and demand whatsoever, which the said Testatrix, Katherine A. Finan,
<br /> Deceased, had in her lifetime, and at the time of her decease, and
<br /> of which the said Party of the First Part, Leo F. Thelen, Executor
<br /> , of the Estate of Katherine A. Finan, Deceased, has by virtue of the
<br /> said Zast Will and Testament, or otherwise, of, in, or to the above
<br /> granted premises, and every part and parcel thereof, with the
<br /> appurtenances.
<br /> TO HAVE AND TO HOLD the above described premises together with
<br /> all tenements, hereditaments, and appurtenances thereto belonging unto
<br /> the said Grantees, Parties of the Second Part, Howard W. Zowell and
<br /> Frances E. Lowell, husband and wife, as joint tenants and not as
<br /> tenants in common.
<br /> And the said Party of the First Part, I,eo F. Thelen, Executor
<br /> of the Estate of Katherine A. Finan, Deceased, for himself, his heirs ,
<br /> executors and administrators, does covenant, promise and undertake to
<br /> and with the said Parties of the Second Part, Howard W. Lowell and
<br /> ; Frances E. Lowell, husband and wife, as joint tenants and not as
<br /> tenants in common, that he is lawfully the Executor of the Last Will
<br /> anel Testament of said Katherine A. Finan, Deceased, and has power to
<br /> � convey as aforesaid, and has in all respects acted, in making this
<br /> � conveyance, in pursuan�e of the authority granted in and by the sai d
<br /> E Last Will and Testament of said Katherine A. Finan, Deceased; and '
<br /> I that he has not made, done or suffered-any act, matter or thing what-
<br /> ; soever, since �e was Executor as aforesaid, whereby the above granted
<br /> ' premises, or any part thereof', are, shall or may be impeached, chaged �
<br /> I or encumbered in any manner whatsoever, and the said Party of the First �
<br /> i Part, Leo F. Tkieleri, Executor of the Estate of Katherine A. Finan,
<br /> ' Deceased, Grantor herein, does hereb� covenant with the :Parties of i
