<br /> EXECUTOR'S DEED
<br /> THIS INDENTURE, Made this 1 S� day of c�//L� 1964, by
<br /> and between DONALD UNDERWOOD of Doniphan, Hall County, Nebraska,
<br /> Executor of the last will and testament of Martha M. Herr, De-
<br /> ceased, late of Doniphan in Hall County, State of Nebraska,
<br /> FIRST PARTY, and ROGER SULLIVAN and BERNIECE SULLIVAN, husband
<br /> and wife, of Doniphan, Hall County, Nebraska, as Tenants in
<br /> Common, SECOND PARTIES:
<br /> WITNESSETH: 2'hat the First Party, the duly appointed,
<br /> qualified and acting executor of the estate of Martha M. Herr,
<br /> Deceased under her last will and testament which is of record in
<br /> the office of the County Court of Hall County, Nebraska, by
<br /> virtue of the power and authority granted and conferred upon him
<br /> under said last will and testament, and in consideration of the
<br /> sum of Twenty Three �housand Five Hundred Dollars ($23, 500.00)
<br /> to him paid by the Second Parties, the receipt whereof is hereby
<br /> confessed and acknowledged, does by these presents grant, bargain,
<br /> sell, remise, release, alien, convey and confirm unto the said
<br /> Second Parties, as Tenants in Common, and to their heirs and
<br /> assigns forever, all the following described property:
<br /> An undivided one-half interest in and to the North
<br /> Half of the Northeast Quarter (N ZNE 4) and the East �
<br /> Half of the Northwest Quarter (E zNW a) of Section
<br /> Thirty-five (35) , Township Ten (10) , Range Nine (9)
<br /> West of the 6th P.M. in Hall County, Nebraska,
<br /> together with the irrigation equipment, tenements, hereditaments
<br /> and appurtenances thereunto belonging or in anywise appertaining;
<br /> and also all the estate, right, title, interest, property, poss-
<br /> ession, claim and demand whatsoever which the said testatrix
<br /> had in her lifetime, and at the time of her decease, and which the
<br /> said First Party has by virtue of said last will and testament
<br /> or otherwise, of in, or to the above granted land and every
<br /> part and parcel thereof, with the appurtenances and irrigation
<br /> equipment.
<br /> TO HAVE AND TO HOLD the said land with the hereditaments
<br /> and appurtenances thereof, unto the said Second Parties, their
<br /> heirs and assigns forever, as Tenants in Common.
<br /> And Esr.s:t: Party for himself, his heirs, executors, and
<br /> administrators, does covenant, promise and undertake to and
<br /> with the said Second Parties, their heirs and assigns, that he
<br /> is the lawfully the executor of the last will and testament of
<br /> said Martha M. Herr, Deceased, and has power to convey as afore-
<br /> said, and has in all respects acted, in making this conveyance,
<br /> in pursuance of the authority granted in and by said last will
<br /> and testament; and that he has not made, done or suffered any
<br /> act, matter or thing whatsoever, since he was executor as
<br /> aforesaid, whereby the above granted premises, or any part thereof,
<br /> are, shall or may be impeached, charged or encumbered, in any
<br /> manner whatsoever; and First Party warrants said title in so far
