TRUSTEE`S DEED
<br /> KNOW ALL MEN BY THESE PRESENTS:
<br /> This deed made by and between GRAND ISLAND TRUST COMPANY,
<br /> a Nebraska corporation, TRUSTEE, of Grand Island, Nebraska, and
<br /> EARL GREENWOOD and JACK GREENWOOD, of Grand Island, Nebraska, as
<br /> follows:
<br /> WHEREAS, the real property hereinafter described was owned
<br /> by Annie M. Crawford prior to her death, and upon her death on
<br /> April 11, 1960, said property passed in accordance with the last
<br /> will and testament of deceased; that a final decree was entered
<br /> in said estate proceedings on October 19, 1960 and was filed in
<br /> the County Court of Hall County, Nebraska on October 27, 1960
<br /> which decreed that the hereinafter described land passed as a
<br /> part of the residue of said estate into the charitable testa-
<br /> mentary trust established in said last will and testament; that
<br /> the United Presbyterian Foundation was named as such trustee under
<br /> said last will and testament, the trust being for the benefit of
<br /> itself and other religious and nonprofit corporations which were
<br /> a part of or affili�.ted with the Presbyterian Church; and
<br /> WHEREAS, said Foundation contracted for the sale of the follow-
<br /> ing described land, and objections were made to the competency of
<br /> the named trustee; thereafter said trustee named in the last will
<br /> and testament, joined with all beneficiaries of said trust, brought
<br /> action in the district court of Hall County, Nebraska, praying
<br /> for a decree declaring said last will and testament to have est-
<br /> ablished a charitable testamentary trust and praying for the
<br /> appointment of a competent trustee thereunder; and that all per-
<br /> sons known to have or claim any interest in and to said real
<br /> estate, including those unknown, real names unknown, were served
<br /> with notice of the pendency of said action by personal service on
<br /> those within the State of Nebraska, and by publication, following
<br /> the order of the court, on all other such defendants; that all
<br /> defendants made default, and on the lOth day of April, 1964,
<br /> said District Court of Hall County, Nebraska decreed that all
<br /> defendants were in default and that all persons had been joined
<br /> who had or claimed any interest in the following described real
<br /> estate; that the last will and testament of Annie M. Crawford,
<br /> Deceased, established a charitable testamentary trust and that
<br /> the following described land became a part of said trust; that
<br /> the laws of the State of Nebraska do not permit such a trust to
<br /> fail for designation of a trustee not competent to receive said
<br /> property; that the Grand Island Trust Company, a Nebraska corpor-
<br /> ation with principal offices in Grand Island, Nebraska; is a
<br /> suitable corporation to act as a trustee and that said corpora-
<br /> tion be appointed as such trustee; and that said decree quieted
<br /> title to said land in the Grand Island Trust Company as Trustee,
<br /> and decreed that all defendants and all persons claiming by,
<br /> through, or under them, or any of them, be forever barred of all
<br /> right, title to, lien upon, or other interest in or to the follow-
<br /> ing described real estate; and
