<br /> 8. As disclosed by the Inventory in this estate, among the assets of this estate w�re the proceeds of an
<br /> undivided one-half interest in the estate of Olga 3: Rost, deceased, Case No. 4115, filed in the Countp Court of Ha11
<br /> Countp, N�braska. Such one-half interest, hawever, was subject to an order entered in such estate on December 28, 1950,
<br /> probiding that such estate should provide for the support and maintenance of Rosann Olga Rost, a minor, iu the sum of
<br /> $200.00, per mnnth, said sum to be charged against gnd paid out of the personal estate and the income of the real
<br /> estate which passed to Grover F. Rost. Such order for the support of Rosann Olga Rost was terminated by final decree
<br /> -3- in such estate, dated April 23, 1952. The undivided inter:est of Grover F. Rost in the estate of O1"ga S. Rost, was
<br /> also subject to Nebraska State Inher�tance taxes in the sum of $27.71. All property nvw undistributed to this estate
<br /> and t o which this estate is entitled, in said estate of Olga S. Rost, shou2d be distributed by the administratrix �e
<br /> bonis non of the estate of Olga� S. Rost, deceased, directly to Rosann Olga Rost, a minor, as the sole beneficiary of
<br /> this estate.
<br /> IT IS, THEREFORE, ORDERED, A�JUDGED� AND DECREED BY THE COt1RT that the aforesaid final report filed herein by
<br /> Wilhelmina C. Rost, administratrix of the estate`of Grover F. Rost, deceased, be and the same is hereby in all things
<br /> approved, settled, confirmed and allawed as and f or the said administrati�cfs final report.
<br /> IT IS, FURTHER ORDERED, ADJUDGED AND DECREED BY THE COURT that bh��w�three clai.ms have been filed against said
<br /> estate, which have been dulq �tllawed and paid in full; that all expenses for the last illness and funeral of said
<br /> deceased have been paid in full; that there should be paid to Charles Bossert, County Jz�dge of Hall �ounty, Nebraska,
<br /> the sum of $75.75 as Probate Court costs herein, inclading p�blication fees; that there should be paid to Wilhelmina
<br /> C. Rost the sum of $650.00 as administratrix�s fees herein; that there should be paid to Paine � Paine, attorneys, the
<br /> sum of $1,300.00, as attorney fees herein; and th�t the Nebraska Inheritance taxes should be allowed in the snm of
<br /> $164.22; that the payn�ent of $475.00 for �, monwnent is approved; and that all person having claims against said estate,
<br /> not f iled within the time filced by the court, if any such there be, are h ereb� forever barred, excluded and enjoined
<br /> from settin� up or asserting any claims whatever against said estate. '
<br /> IT IS FURTHER ORDERED, ADJ UDGED AND DECREED BY THE COURT that the said Grovar F. Rost, deceased, passed away
<br /> intestate on the 15th�day of October, 1950, being at that time a citizen and a resident of Grand Island, Hall Countp,
<br /> Nebraska; that his wife, Olga S. Rost, and his parents preceded him in death; and he left surviving him, as his sole
<br /> and only heir-at-Iaw, the follawing, namely:
<br /> Rosann Olga Rost, his daughter, a minor naw 11 years of age, of 623 West '11�ielfth Street, Grand Island, Nebraska;
<br /> -4- and that he left no other living children, or living issue of any deceased ch�ld or children, and all remaining assets of
<br /> ���`' this estate� should be distributed to said Rosann Olga Rost, a minor.
<br /> �: : _ IT IS FURTHER ORDERED, ADJ UDGED AND DECREED BY THE COURT that all of the real estate awned bg the said Crover F.
<br /> Rost, deceased, at the tim e of his degth, of which the said deceased died seized and possessed, to-wit:
<br /> (a) Lot Five (5), in Block Forty-si.x (46), in Russell Wheeler�s Addition to the City of Crand Island,
<br /> Nebraska; �
<br /> (b) An undivided one-fifth (1/5) interest in the Southwest Quarter (SW4) of Section 'l�ienty-seven (27),
<br /> township six (6), North Range si�cteen (16), West of the 6th P. M., in Kearney Countp, Nebraska;
<br /> (c) An vndivided �ne-half (1�2) interest in the North Half (N2), and the S outh Half of the Southeast
<br /> Quarter (S2SE4) of Section 7w►enty-nine (29), in Tawnship Seven �?), North, Range 7�vo (2), East of the
<br /> 6th P. M., in Salsi.ne Conntp, Nebraska.
<br /> did descend at the time of his death, and passed by fee simple title absolute, under ar� by virtue of the Statutes of
<br /> Descent of the State of Nebraska,in full €orce arni effect at the time of the death of the said Grover F. Rost, deceased�.
<br /> to his sole and onlp heir-at-law, namely, Rosann Olga Rost; and distribution thereof is herebp accordingly made and
<br /> directed. ' '
<br /> IT IS FUR`THER ORDERED, ADJUDGED AND DECREED BY THE COURT that this estate was subject to a Federal Estate tazc in
<br /> the sum of $203,22, which s um was pa.id on Januarp 12, 1952, and said administratrix by letter dated August 8, 1952, was
<br /> informed bp the Commissioner of Internal Revenue that the estate tax return filed bq said administratrix has been
<br /> finally approved and has been accepted as filed. Determination lias been made of the Nebraska State Inheritance tax and
<br /> the amount determined to be due is $164.22 and such amount should be paid.
<br /> IT IS FURTHER ORDntED, ADJUDGED AND DECREED BY THE COURT that, among the assets of this es�ate, as disclosed by
<br /> the Inventory in this estate, there were the proceeds of am=undivided one-half interest in the estate of Olga S. Rost,
<br /> deceased, Case No. 4115, f iled in the Caunty Court of Hall County, Nebraska, such one-half interest, hawever �ras subjeGt
<br /> -5- to an order entered in such estate on December 28, 1950, providing that such estate should provide for the support
<br /> and ma,intenance of Rosann Olga Rost, a minor, in the sum of $200.00 per month, said sum to be charged against, and paid
<br /> au�°-of, the personal estate and the incaane of the real estate, which passed to Grover F. Rost. Such order for the
<br /> support crf Rosann Olga Rost was terminated by final decree in such estate, dated April 23, 1952, The undivided interest
<br /> nf Grover F. Rost in the estate of Olga S. Rost was also sub�ect to Nebraska State Inheritance taxes in the sum of
<br /> $27.71. �}.1 propertq naw wndistributed to this estate and to which this estate is entitled in said estate of Olga �.
<br /> Rost, should be distributed by the administratriac de bonis non of the estate of Olga S. Rost, deceased, directly to
<br /> Rosann Olga Rost, a minor, as sole beneficiarp of this estate, and distribution thereof is hereby accordingly �nade. '
<br /> IT IS FUR�HER ORDERED, ADJUDGED AND DECREED BY THE COURT that upon the filing herein by the said administratrix
<br /> of her final rece�pts herein, said administratrix shall be discharged, and the liabilitp of said administratrix and her
<br /> suretp on her off icial bond shall be terminated� and her b��i shall be released, and this said estate shall be settled
<br /> and closed.
