<br /> That on the 18th day of December, 1951, Grand Island Trust Company of Grand Island� Nebraska, filed in this Court
<br /> an instrument purporting to be the last Will and Testament of said Mathilda Peers, also knawn as Matilda Peers� deceased,
<br /> wherein the said petitioner was named Executor, and a petition offering said Will for probate, and on the lSth day of
<br /> -2- December, 1951, an order of this Court was made therein assigning the 1?th day of Januarp, 1952, at 10 o�clock A.M., in
<br /> the Countp Court Room in said County as the time and place for hearing said petition, proving said Will and admitting
<br /> the same to probate, and ordering that notice of the pendency of said petition and hearing thereon be �given to all
<br /> persons interested in said matter bp publishing said notice in the Grand Island Independent, a legal newspaper printed
<br /> in said Coun*..g, for three successive weeks prior to said day of hearing, and it appears by proof on file that notice
<br /> of said �rder was so given.
<br /> THIRD
<br /> The Court further f inds that on the 17th dap of January, 7_952, said instrument was proven, allawed and admitted to
<br /> probate as the Last Will and Testament of said Mathilda Peers, alsa knawn as Matilda Peers, deceased, which Last Will
<br /> and Testament is in words as follows;
<br /> t'LAST WII.L AND TESTAMENT OF MATHILDA PEERS
<br /> I, Mathilda Peers, of Grand Island, Hall County, Nebraska, being of sound mind and disposing memory, do make,
<br /> publish, and declare this to be my last will and testament, in the manner and form f ollawing;
<br /> FIRST
<br /> I direct my executor, hereinafter named, to pay all just debts, the expenses of my last illness, funeral e�penses,
<br /> ar�d costs of administration.
<br /> SECOND
<br /> I give, devise, and bequeath unto my husband, Carsten Peers, all of my property of every description, both real
<br /> and personal.
<br /> THIRD
<br /> In the event that I survive my said husband, Carsten Peers, then I �ive, devise, and bequeath unto The Crand '
<br /> Island Loan and Trust Company, as trustee, all of my property of every description, both real and personal, for and
<br /> upon the follvwing purposes and conditions:
<br /> I direct that in the event I survive my husband that within a year after my death the said Trustee, The Grand '
<br /> Island Loan and Trust Company, shall pay and deliver to my only child, Maggie Peers Kroger, the sum of Fifteen Hundred
<br /> ($1500.00) Dollars, and the residue of my estate shall then be held by said Trustee and invested in good securities, and
<br /> the income therefrom shall be paid to my said daughter, Maggie Peers Kroger, annually, until she attains the age of
<br /> fifty years, at which time said trust shall terminate and all of the property then held by said trustee, as herein
<br /> provided, shall be paid to and delivered to mp► said daughter, Maggie Peers Kroger.
<br /> FOURTH '
<br /> In the event that said Maggie Peers Kroger dies before attaining the age of fiftq pears, then all of said propertp
<br /> shhll continue to be held bp The Grand Island Loan and Trust Company, as trustee, and the income therefrom shall be
<br /> paid, annually, to my only grandson, Arnold Kroger, the son of said Maggie Peers Kroger, ur.til �nch time as said
<br /> Maggie Peers Kroger would have reached the age of fifty years, at which time all of said property then held bp said
<br /> trustee as herein provided, shall be paid and delivered to said Arnold Kroger.
<br /> FIFTH
<br /> _3_ I hereby nominate and appoint The Grand Island Loan and Trust Company executor of this, my last will and testamertt.
