<br /> At a session of the County Caurt held in and for said County of Hall in the State of Nebraska, this llth day of
<br /> June, 1952.
<br /> Present: Charles Bossert, County Judge.
<br /> BE IT REMEMBERED that on the 21st day of Ma.p, 1952, Wiln►a Vvdehnal, Executrix of the Estate of Anna Kluge, deceased�
<br /> f iled in this Court her account as such Executrix and a petition praping that saidac'count be allawed, for a decree of heir-
<br /> ship, determination of inheritance tax, fees and cc�issions, a decree of distribution and settlement th ereon.
<br /> For these purposes the llth day of June, 1952, at 10 orclock a.m., at the County Court Room in said Count� was
<br /> assigned as the time and plact for hearing said petition, examining and allawing said account`ing and it was ordered that
<br /> notice of the pendency of said petition be givett to all persons interested i.n said estate bp publishing such notice in
<br /> the Grand Island Independent, a legal newspaper printed in said Countp, for three weeks prior to said day of hearing;
<br /> and it appears by proof on file that said notice was given as ordered bq Court and that no ob.3ections to said account
<br /> have been made of f iled.
<br /> Upon examination of the record and the evidence in this matter and being duly adwised in the premises, the Court
<br /> finds as follaws:
<br /> FIRST
<br /> That Anna Kluge departed th is life on September 2, 1951, in Grand Island, Hall County, Nebraska, testate, and at
<br /> the time of her death she was a resident of Hall County, Nebraska.
<br /> SECOND
<br /> That ,on the ?th day af September, 1951, Wilma Vodehnal filed in this Court an instrument purpo ting to be the
<br /> Last Will and Testament of said Anna Kluge, deceased, wherein said petitioner was named Executrix and�etition offering
<br /> said Will for probate, and on the ?th day of September, 1951, an order of this Court was made therein assigning the 3rd
<br /> day of October, 1951, at 10 o�clock a.m., in the County Court Room in said County as the time and place for hearing said (2)
<br /> petition, proving said Will arxl admitting the same to probate, and ordering that notice of the pendency of said petition
<br /> and hearing thereon be given to all person s interested in said ma.tter by publishing said notice in the Grand Island Inde-
<br /> pendent, a legal newspaper printed in said County! for three successive weeks prior to said day of hearing, and it
<br /> appears by proof on file that notice of said. order was so given.
<br /> THIRD
<br /> The Court further f�nds that on the 3rd dap of October, 1951, said instrua�ent was proven, allawed and admitted
<br /> t robate as the Last Will and Testament of said Anna Kluge, deceased, which Last Will and Testament is in words as
<br /> f o l�vhts; ,
<br /> " LAST WILL AND TESTAMENT
<br /> I, Anna Kluge, of Grand Island, Nebraska, being of sound mind and disposing memory, do herebp make, ��publish and declare
<br /> this my Last Will and Testament in words as follaws:
<br /> I
<br /> I herebp appoint rny daughter, Wilma Vodehnal Executrix of m,y estate and request that she pap the expenses of my
<br /> last illness, buria.l and a suitable marker at my grave as soon as map conveniently be done; I also direct my Executrix
<br /> to pay all debts legally enforcible against my esta�e and if my personal property shall be insugficient for that purpose,
<br /> I herebp authorize and empawer her to sell at public sale so much of my real estate as may be necessary to mske such pap-
<br /> ment without first procuring the license or leave of arry Judge or Court whatsoever therefor.
<br /> II
<br /> All the rest, residue and remainder of my estate I herebp dixect nry said Executrix to sell at public sale in
<br /> such manner as she may deem for the best interests of mq estate, and after payment of all expense incident thereto, which
<br /> I hereby authorize, I hereby bequeath, and direct her to divide and pay the remainder in her hands as follo�ws:
<br /> One-fourth (1/4) part to the clas s consisting of Patsy Ann Kluge, Myron Kluge, Jr., Gloria Jean Kluge and
<br /> Melvin James Klu��, they being the children of �* son Myron Kluge;
<br /> One-fourth (1/4) part t o my son Merlin Kluge '
<br /> One fourth (1/4) part to mp daughter Wilma Vodehnal !
<br /> One-fourth (1/4) part to the class consisting of Fred�,, Kluge, Theodore Kluge and Ronald Kluge, children of �
<br /> my deceased son Vernon Kluge;
<br /> III
<br /> Should any of mp gran dchildren named in the preceding p�ragra�h not be living at the time of my death, then the
<br /> shares of these ` grandchildren living in the class in which such predeeeased grandchildren belong shall be increased
<br /> accordinglp.
