<br /> HANNAH JANE GUTHRIE, DECEASED. �
<br /> Naw, on this 28th day of Map, 1952, this cause came on for hearing upon the Final Report filed herei.n by Louis A.
<br />, Holmes, the Ad�inistrator of said estate, and upon his Petition f or the approval and allawance of said Report,
<br /> settlement of said estate, determination of heirs, a�1 his discharge herein, and the Court having examined the records
<br /> and being fully advised of the premises finds:
<br /> That Sarah M, Hannan, daughter of Haruiah Jane Guthrie, deceased, f iled her Petition in this Court on Julp 11, 1951,
<br /> alleging among other things that Hannah Jane Guthrie died intestate June 27, 1951, and Was at that time a resident of
<br /> said Countq and State, and the awner of an estate to be administered in said Countq, that Petitioner prayed that
<br /> Louis A. Holmes be appointed Administrator of said estate; that upon reading said Petition and taking evidence thereon,
<br /> an Order was ent�red fixing the time and place for hearing the evidence in support of said Petition, giving notice
<br /> thereof to all interested parties by publishing said notice for three (3) successive weeks in the Grand Island Daily
<br /> Independent, a legal newspaper published and circulated in said County; that said hearing �as had as by la�r required;
<br /> that letters of Administration were granted to Louis A. Holmes, upon the filing of his bond in this Court as bp law
<br /> required.
<br /> The Court further f inds that due and legal notice has been given` to a11 persons of the time and place fixed by the
<br /> Court f or the filing of claims against the estate by publication for three (3) saccessive weeks in the Grand Island
<br /> Daily Independent, a le�al newspaper, as by law requi.red, and all persons having claims against said estate not
<br /> filed within��the time fixed by said Cpurt, if any such there be, sh auld be forever barred, excluded, and en3oined by
<br /> -1- setting up and asserting any claims against said estate.
<br /> The Court further finds that the deceased, at the time of her death, a�wned no persanal property with which to
<br /> defrag expenses of Administ��tion, or pay clai�s agafcs t said esta�; that the onlp property awned bp said decedent at
<br /> the time of her death was an undivided 1/3 interest in real property hereinafter described; that the Administrator
<br /> f iled a Petition in the District Caurt of said County, praying that a license be granted to sell said undivided interest
<br /> in said real property; that by authority of said license said undivided interest in real property was sold by order of
<br /> the Court; that the money so derived from the sale of said propartp was insufficient to pay all costs of Administration
<br /> and claims filed against said estate; that payments of costs of Administration and claims was made as provided for in
<br /> Section 30-615 Revised Statutes of Nebraska 19d3, Reissue of 1949; that the County of Hall, State of Nebraska filed a
<br /> claim for $5931.32 against said estate for Old Age Assistance received by said Hannah Jane Guthrie, deceased, during
<br /> her lifetime; that the Cottntp of Hall, by its duly elected, qualif ied and acting Board of Supervisors, entered into
<br /> a comprc�eni.se in the settlement of said claim against said estate; that the County Board of Supervisors in and for
<br /> Countp of Hall, by a Resolution legallq enacted, compromised said claim and upon payment, the County Treasurer of said '
<br /> Gountp released said claim a nd lien against said property.
<br /> The Court further finds that the deseased departed this life leaving no spouse and leaving surviving her as her
<br /> heirs at law and only heirs at law, and persons entitled to share in her estate, the follawin�, to-wit: ,
<br /> Sarah M..Hannan, daughter, of Crand Island, Nebraska �
<br /> Geraldine L. Miller, granddaughter, of Scottsbluff, Nebraska
<br /> all of legal age; , i
<br /> The Court further finds that the deceased died awner of an und ivided 1/3 interest in t:he f ollowing described
<br /> -2- propertp situated in Hall County, Nebraska;
<br /> An undivided 1/3 interest in7and to Lot Three (3), Block Seventeen (17), Original Tawn, naW City of Grand
<br /> Island, Nebraska, as surveyed, platted and recorded;
<br /> Ttlat due and legal notice has becn given to all persons of the time and place fixed bp said Court for a hearing !
<br /> of the F'inal Report, by publication of said notice for three (3) successive weeks in the Grand Island Daily Independent� ,
<br /> as by law required, and no one appearing to object to said Report and the Court having examined same, finde that the
<br /> Report is t�ue and correct in all things, and shauld be approved and alla�►ed; that said estate should be settled _and
<br /> closed and the Administrator should be discharged from his official bond. I
<br /> The Court further finds that all claims and expenses against said estate have been paid by the Administrator, by
<br /> order of the Court; that said estate is not subject to payment of any inheritance taic under the laws of the State of
<br /> Nebraska, of the United States; that the said propertp does not quali.fy as an exemptia�►► as a homestead.
<br /> IT IS THEREFORE ORDERED, ADJUDGED AND DECREED bp the Court that anp and all persons having claims against said estate
<br /> not f iled and allared w ithin the time f ixed bp the Caurt, if any such there be, are forever barred and enjoined from
<br /> setting up or asserting any such claims against said estate; that the compromise entered into bp the County of Hall,
<br /> State of Nebrask a, a� said heirs of this estate is herewith a�proved.
<br /> IT IS FURTHER ORDERED, ADJUDGED Ar'D DECREED by the Court that the f oll�wing persons are the heirs at law and only
<br /> heirs at law of the deceased:
<br /> Sarah M. Hannan, daughter, of Grand Island, Nebraska
<br /> Ceraldine L. Miller, granddaughter, of Scottsbluff, Nebraska.
<br /> IT IS FURTHER ORDERED, ADJUDGED AND DECREED bp the Court that the deceased died owner of the f ollowing described
<br /> real property, to wit:
<br /> An vndivided 1�3 interest in and to Lot Three (3), Block Seventeen (17), Orig�cial Town, naw City of Grand Island
<br /> -3- Nebraska, as surveyed, platted and recorded.
<br /> that the title thereto belonging to said deceased, was sold bp order of the District Court of Hall �ounty, Nebraska,
<br /> under a license issued bp the Court for the purpose of paying the costs of Administration and claims against said estate,
<br /> IT IS FURTHER ORDERED ADJUDGED AND DECREED by the Court that the Final Report filed by Louis A..Ho�mes, Ad�inistrator
<br /> be and the same is hereby in all thin�s approved and allowed; that said estate is herewith settled and closed, and said ;
<br /> Administrator and his sureties are discharged on his official bond.
