<br /> l�aw on th is 21st day of May, 1952, this cause came on for hearing upon the Final Report of Walter Boltz, Executor,
<br /> and Fred Boltz, Administrator with the Will annexed, of the Estate of Fdward Boltz, deceased, a� upon the Petition
<br /> of said Executor and Administrator for the allowance and ap�roval of said Report and the settlement of the estate and
<br /> their discharge herein as such Executor and Administrator, ard the Court having examined the records and f iles herein
<br /> and being fully advised in the premises finds that due and legal notice has b��n given to all persons of the time and
<br /> place f iaced by the Court for th e b.earing upon said Final Report a.nd no ant appearing to object thereto and the Court
<br /> having examined the same, together with the veuchers on file, finds that the Report is true and correct in all things
<br /> and that the same ought to b� a�proved and ail aved as a.nd f or the Final Report cf the Executor and Administrator and
<br /> the Estate closed and they be discharged upon the f iling of receipts shvwing distribution in full of the remaining
<br /> funds in their possession, in accordance with the provisions of the Will.
<br /> The Court f inds that the said Edward Boltz departed this life on November 22, 1951, in Grand Island, Hall County,
<br /> Nebraska, and that at the time of his death he was a resident and inhabitant of Hall County, Nebraska, and left a
<br /> Last Will and Testament wh ich was, upor. consideration of the �uurt, duly proven, all aaed and admitted to probate on
<br /> December 26, 1951; that in the sa.id Last Will and Testament Wa.l�er Boltz was named Executor and at the hearing he was
<br /> appointed as such, and Fred Boltz was appointed Adm�.nistrator with the Will annexed, and letters testamentary were
<br /> duly issued to them upon qual.ifying as such Executor and Administrator. -1-

<br /> The Court further finds that due and legal notice has been given to all persons of the time and place fixed by
<br /> the Court for filing claims against the Estate of the deceased, and that the time so f ixed has fully expired and all
<br /> persons having claims against the estate and not filed within the time limited are forever barred and excluded from
<br /> setting up or asserting such claims.
<br /> The Court �'urther finds that the Executor and Administrator have paid all the funeral expenses of the deceased, all
<br /> the debts against tht estate and the costs of these proceedings and that they have made distribution of the balance of
<br /> the funds to the beneficiary, pursuant to the d�irections in the Will.
<br /> The Court further finds that due and legal notice was given� �o the County Attorney of Hall County, Nebraska, being
<br /> the only county in wh ich assets of the estate are located, that hearing would be had in these proceedings to determine
<br /> inheritance tax liabili.ty, if any, under the laws of the State of Nebraska, and the Court finds that the estate of said
<br /> deceased was neither subjec* to an inheritance tax under the laws of the State of Nebraska, nor to a federal estate
<br /> tax under the laws of the IJnited States.
<br /> The Court further finds� that the said Edward Boltz at the time of his death was the awner of real estate described
<br /> as Lot Eigbt (8) in Section Twenty-Three (23), Lots 1�0 (2) and Three (3) and the Northeast Quarter of the Northwest
<br /> Quarter (NE�NW4) in Section Tt,renty-Siac (26), and Lots Five (5), Six (6), Seven (7) and Eight (8) in Section `
<br /> 'i�,ienty-Seven (27), Township Ten (10), North Range Ten (10), West of the 6th P. M., Hall Caunty, Nebraska, containing
<br /> 235 acres, more or less, which real estate was devised to Minnie Boltz, widow of the decedent, she to have $nd to
<br /> hold the same for and durin� her natural lifetime, and to have the use thereof and a 11 rent and income therefrom for so
<br /> long as she lives and to pay the taxes and keep the improvements in good repair and that subject to her life estate
<br /> said real'estate was devised to f ive daughters and two sons of the decedent, they being Frieda Gulzow, Eirena Mathiesen
<br /> ren
<br /> Rohweder, Bertha Luebbe, Mela Hueneke, also known as Amelia Hueneke, and Gladys Hadenfeldt, and Walter Boltz and Fred -2-
<br /> Boltx, in equal shares, �o have and to hold the same forever.
<br /> The Court further finds that the said Edward Boltz, left surviving hi.m as his heirs at law and only heirs at law,
<br /> the following named persc�ns: Minnie Boltz, wid a�, and Frieda Gulzow, Emma Mathiesen Rohweder, Bertha Luebbe, Mela
<br /> Hueneke, also known as �,me�ia Hueneke, and Gladys Hadenfeldt, daughters, and Walter Boltz and Fred Boltz, sons, and that
<br /> all of said heirs at law are of legal age.
<br /> IT IS, TH EREFORE, ORDERF.D, ADJUDGED AND DECREED BY THE COURT that the Final Report of Walter Boltz, Executor and
<br /> Fred Boltz, Administrator with the Will annexed, of the estate of Edward Boltz, deceased, be and the same hereby is in '
<br /> �,
<br /> all things approved and allowed as and for the Final Report �f the said Executor and Administrator, and the estate is
<br /> hereby settled a.nd closed, subject to f inal settlement with Minnie Boltz, residuary benefici.ary, of funds in their
<br /> possession and the filing of her receipt for the same, and the F.xecutor and Administrator discha.rged upon such f iling.
<br /> IT IS FG'RTHER ORDF.RED, ADJUDGFD AND DECREED BY THE COURT that all persons having clai.ms against said Estate, if
<br /> any such there be, are forever barred, en,joined and excluded from ever setting up or asserting the same.
