<br /> thereon be given to all persons interested in said estate by publishing said notice in the Wood River Sunbeam, a
<br /> newspaper printed in said county, for three successive weeks prior to the day of the hearing and it appEars from the
<br /> proof on f.ile that notice of said order was given as ordered by the Court; that Katherine A. Finan was upon such
<br /> hearing duly appointed. administratrix of this estate as prayed and upon giving bond in the amount of $300.00, as
<br /> ordered by the Court, Letters of Administration were duly issued to her.
<br /> The Court further finds that due and. legal notice was given to all persons of the time and place fixed for
<br /> fi�ing of claims and that all claims file d have been f ully satisfied by the administratfix, Katherine A. Finan, from
<br /> her own persenal funds, and that the time so fixed by the Court for the filing of claims has fully expired and an
<br /> order has been dulp entered barring all further claims.
<br /> The Court further finds that the deceased at the time of her death left the following heirs-at-law, all of lega�
<br /> age:
<br /> Frances M. Hardy, Mary Hewitt, Katherine A. Finan, and .James P. Finan, being sisters and brother of the deceased�
<br /> Ronald P. Finan, Ann� Marie Watson, and Ar.drew P. Finan, nephews and niece of the deceased, being children Qf
<br /> Andrew P. Finan, brother of the deceased, w ho died prior to the death of Ellen Theresa Finan,
<br /> Dr. F,. P. Thelen, 'and Leo Thelen, nephews being children of Alice Finan Thelen, sister of the deceased, who
<br /> died prior to the death of Ellen Theresa Finan.
<br /> The Court further f inds that the deceased was, at the time of her death, the awner of the follo�ring described re�l
<br /> property, to--wit:
<br /> An undividec� one-thi.rd. �r.ter�st i.r.and �c *he SczYth Half of the Southwest Quarter (S2SW4); Southwest Quarter of
<br /> the Southeast Quarter (SW4SE4); Northeast �uarter of the Southeast Quarter (NE4SE�); all in Section Sixteen
<br /> (16), Township Ten (10), Range Eleven (11), Hall County, Nebraska, and an undivided one-�hird interest in and
<br /> to the Southwest �uarter of the A'orthwest Quarter �SW4NW4), of Section 'I�wenty-one (21), Township Ten (10),
<br /> Range F.leven (11), Hall County, Nebraska.
<br /> The Court further finds tha.t in addition to the above real estate the deceased, Ellen Theresa Finan, under and by ,
<br /> the name of Nellie Finan, owned as joint tenants with the right of survivorship with Katherine Finan, the following
<br /> described rea.l estate, to-wit;
<br /> Lot Six (6), Block ffE1f, MacColl and Leflang�s Second Addition to the Town of Wood River, Hall County, Nebraska.
<br /> The Caurt further f inds tha.t in addition to the above described real estate the deceased was, at the time of I
<br /> her death, the owner of a checking account in the Bank of tdood River, Wood River, Nebraska, in the aroount of ltiao
<br /> Nundred 1�enty-Three and 13/100 Dollars, (�223.13).
<br /> The Court further finds that according to the laws of descent and distribution of the State of Nebraska the �
<br /> property of the deceased, upon her death, passed and descended as follows: I
<br /> To Frances M. Hardy, Mary Hewitt, Katherine A. Finan and James P. Finan, being sisters and brother of the
<br /> decea.sed, each an undivided one-sixth thereof;

<br /> To Ror.ald P. Finan, Anna Marie Watson, and Andrew P. Finan, nephewsand neice of the deceased, be:ing children of '
<br /> Andrew P. Finar_, brother of the deceased, who died prior to the death of Ellen Theresa Finan, each an undivided
<br /> one-eighteenth thereof;
<br /> To Dr. F. P. Thelen and Leo Thelen, nephews, being children of Alice Finan Thelen, sister of the deceased, who
<br /> died prior to the death af Fllen Theresa Finan, each an undivided one-twelfth thereof.
<br /> The Court furhter finds that John R. Higgins was duly appointed appraiser for inheritance tax purposes and that he
<br /> took his oath. and after notice and hearing, as by law required, on the 24th day of September, 1951, filed his report
<br /> as such appraiser and that thereafter an order was duly entered by this Court approving such report and appraisement
<br /> and f inding that the sha.res and interests of the heirs in this said estate were }�ss than their statutory exemption and
<br /> that, no tax was due thereon.
<br /> The Court further finds that the court costs in the amount of $69.75 have been paid and that the balance of the
<br /> funds in this said estate were insufficient te pay the attorneys fees, the claims allowed against this said
<br /> estate and that such fees and claims have been paid by the administratrix from her own personal funds and that there
<br /> re�nains no personal property of any kind for distribution in this said estate.
<br /> IT IS, THEREFORE, ORDF.RED, ADJUDGF.D AND D�CREED BY THE COLTRT that the final report of Katherine A..Finan be, and
<br /> the same hereby is, allowed, as and. for her final repor.t; that Frances M. t�ardy, Mary Hewitt, Katherine A. Finan and
<br /> James P. Finan, sisters and brother of the deceased; Ronald P. .Finan, Annm Marie Watson, and Andrew P. Finan, children
<br /> of Andrew P, Finan, a brother of the deceased, who died prior to the death of Ellen Theresa Finan, Dr. E. P. Thelen,
<br /> and Leo Thelen, children of Alice Finan Thelen, sister of the deceased, who died pr�or to the death of the deceased,
<br /> Ellen Theresa Finan, are all and the only heirs at law of said deceased, and that the real estate awned by the
<br /> deceased, at the time of her death, passes and deseends according to the law of descent and distribution of the state
<br /> of Nebraska, as follaws:
<br /> To Frances M. Hardy, Mary Newitt, Katherine A, Finan and James P. Finan, each an undivided one-si�cth thereof;
<br /> To Ronald P. Finan, Anna Marie Watson and Andrew P. Finan, each an undivided one-eighteenth thereof;
<br /> To Dr. E. P. Thelen and Leo Thelen, each an undivided one-twelfth thereof:
<br /> that the administratrix, Katherine A. Finan has made a full and complete distribution of this said estate according to
<br /> law and has f iled receipts showing such payment, and she is hereby discharged as such administratrix and her bond is
<br /> hereby released and this said estate fully settled and closed.
