<br /> Naw on this 9th day of April, 1952, this cause having been continued from March 19, 1952, came on for hearing on
<br /> the Final Report filed herein by Charles Westphal, executor of said Estate and upon his app�lication for the app�ruval
<br /> and allowance of said report, settlement of said Estate, and discharge as executor; and the Court having examined the
<br /> records and files herein, including the Final Report, and t�eing fully advised in the matter, finds as f ollaws: ��
<br /> That on the 21st day of September, 1951, Charles Westphal and Lloyd W. Kelly, the named joint execut�ors in the �!,
<br /> Last Will and Testament of said deceased, filed their Petition in this Court in which said joint executors alleged, I
<br /> among other things, that Henry Westpah�., departed this life on the 13thday of September, 1951, a resident and
<br /> inhabitant of Ha11 County, Nebraska, and left a Last Will and Testament at the time of his demise in which he named
<br /> Charles Westphal and Lloqd W. Kelly as joint executors thereof, which said instruraent was offered for probate as
<br /> the Last Wi11 and Testament of the said Henrp Westphal, Deceased; and that the said Charles Westphal and Lloyd W. Kelly
<br /> be appointed as joint executors; and that thereafter on the 17th day of O�tober, 1951, Lloyd W. Kelly filed his disclaimer
<br /> in said matter; that upon reading and filing said Petition, this Court entered an Order f�ing the time and place for
<br /> hearing on said Petition, and Disclaimer, and gave notice thereof as by law provided; said matter then coming on to
<br /> be heard on the date fix�d by the Caurt, said instrument was duly admitted to probate as the Last Will a nd Testament
<br /> of the said Henrp Westphal, deceased, and Letters of Administration �ere issued to the said Charles Westphal.
<br /> That due and legal notice has been given to all persons interested, of the ti.me and place fixed by the Court
<br /> for filing claims against said Estate, andall claims not f iled within the time fixed by the Court, if any 5�ich there
<br /> be, should be forever barred and excluded and enjoined from setting up or asserting any such cla�.ms against sa

<br /> That the deceased departed this life leaving as his heirs-at-law, and onlp heirs-at-law, devisees, legatees, and
<br /> persons entitled t o �hare in his said Estate the f ollawing named persons, to-wit :
