<br /> The Court further finds that on the 2nd day of July, 1951, upon motion of said Theodore William Baumer and
<br /> Herbert F. Mayer, petitioners, the Court entered an order continuing the hearing on said petitican to July 19, 1951,
<br /> at 10 otclock a.m., of said day, and that on the 16th day of July, 7.951, a comproiaise settlement was effected between
<br /> Charles Wasmer, Caroline R, Ashton and Isabel Wasmer with Arthur C. Mayer, all being residuary legatees under said
<br /> Last Will and Testament and Codicils thereto being offered for probate herein, by the terms of which compromise
<br /> settlement Robert Metz was to receive $140.00 plus an undivided one-seventh of the residue of said estate, Charles
<br /> Wasmer $100,00 �ilus one-seventh of the residue of said estate, Caroline R. Ashton $100.00 plus one-seventh of the
<br /> residue of said estate, Isabel Wasmer $100.00 plus one-seventh of the residae of said estate, Louis Wasmer $100.00
<br /> plus one-seventh of the residue of said estate, Arthur C. Mayer, $500.00 plus one-seventh of the residue of said
<br /> estate, and Fred Funk $50.00 plus one-seventh of the residue of said estate;

<br /> The Court further f inds that on the 19th day of July, 1951, said instrumenta were proven, allowed and admitted to
<br /> probate as the Last Will and Testament and Codicils thereto of Charlotte C. Wasmer, also known as Charlotte C. von
<br /> Wasmer, deceased, which Last Will and Testament and Codicils thereto are in words as follc�►s:
<br /> THE LAST WILL OF CHARLOTTE C. Von WASMER (3)
<br /> I, Charlotte C. von Wasmer of Grand Island, Nebraska, make this my last will and testament hereby revoking all
<br /> former wills by me made,
<br /> 1.
<br /> I hereby appoint ArthUr C, Mayer and Herbert F. Mayer, executors of this will.
<br /> � 2.
<br /> Said Executors shall pay the expenses of rny last illness, burial and my just debts out of my personal property
<br /> and if that is insufficient, out of the proceeds of the sale of my real estate as hereinafter provided. They shall
<br /> cause to be erected on my burial site a monument polished on all sides, erected at a cost not to exceed $450.00 and
<br /> theq shall have three headstones placed on said lot with proper inscriptions at an expense not to exceed $50.00.
<br /> 3.
<br /> I give, devise and bequeath unto the said Arthur C. Mayer and Herbert F. Mayer all my estate, whereever the same
<br /> may be situate, consisting of real estate and personal property to be held by them as Trustees for the payment of mp
<br /> debts and the legacies herein set out.
<br /> 4.
<br /> I give them, the said Arthur C. Mayer and Herbert F. Mayer, full power to sell or dispose of my real estate as
<br /> they may see fit and convert the same into monep as early as they deem advisable after my death and after the payment
<br /> of all expenses incident to said trust herein created, expenses of last illness, burial, costs of probating this will
<br /> and administering upon my estate and all expenses which the said trustees may have incurred or fees to ' which they '
<br /> may be entitled, the balance, rest and residue shall be paid to the follawing named persons and I hereby give them
<br /> the amounts set opposite their respective names, to-wit:

<br /> To the Trustees of St. Paults English Luthern Church of Grand Island, Nebraska, which church mp sister and I have
<br /> attended for many years, I give the sum of One Thousand Dollars ($1,000.00) for the Church Building fund, and the
<br /> receipt of the Treasurer of said church shall be a complet� satisfaction of this legacy. On Memorial Day of each year,
<br /> and at such other times as the Trustees may desire, flowers shall be placed upon my cemetery lot. After said legacy
<br /> has been paid to the Trustees of the St. Paults English Luthern Church, said church shall place flowers upon our Zot
<br /> for such a period of time as such Trustees shall deem fit and proper.
<br /> 6.
<br /> In the event that my estate should not be large enough to pay the legacies herein provided, all of them shall be
<br /> scaled down in the same proportion. If, hawever, on the other hand, my estate should be more than enough to pay the
<br /> costs, debts, expenses and legacies, then and in that event, the following legacies shall be augmented and I do
<br /> increase the legacies to Herman Metz, Charles Wasmer, ffCarrie Ashton, Isabel Wasmer and Louis Wasmer in an amount (4)
<br /> which will absorb said surplus. To Mrs. Frieda Roeser I give Fifty Dollars to be treated the same as the other j
<br /> legacies in this paragraph. �I
