<br /> Herman T. Wegner, Deceased. ) FINAL DECREE
<br /> Now on this 27th day of February, 1952, this cause came on to be heard on the petition of the executors, Emil Mahn
<br /> and The First National Bank of Grand Island, for final settlement of this said estate and their discharge as exe�utors
<br /> and for the assigrnnent of the real estate of said estate and was sub�aitted to the court and the court after being
<br /> fully advised in the premises and apon due consideration of the evidence finds that due and legal notice of the time
<br /> and place of hearing on said petition for f inal settlement has been given to all persons interested in said estate, as _
<br /> provided by law. Thereupon the court, being duly advised in the premises, f inds as follows: �
<br /> (1) That heretofore, and on the 20th daq of March, 1950, the executors herein filed their report and account and
<br /> petition for distribution of the personal property of this said estate; that thereafter, and on the 27th day of April,
<br /> 1952, an order was duly entered by this court, allawin�g and approving such report and account, directin� the payment
<br /> of the claims, court eosts, fees and coltnnissions and assigning and sett ing over to Meta Wegner the remaining personal
<br /> propertp in this said estate; that the sums in the hands of th e executors were insufficient to pay in full the court
<br /> costs, the executors fees and congnissions, and the attorneys fees; that the court costs in the aanount of $92.72, the
<br /> executors fees in the amount of $100.00, were paid in fu11 by the executors; that attorneys fees as allawed in this
<br /> said estate were in the amount of $719.76 of which sum the executors have paid $602.38, leaving a balance due on
<br /> attorneps fees in this said estate of the sum of $117.58. That such balance due has been paid bp the heirs.
<br /> (2) That under, and by the terms of the last will and testament of the deceased, Meta Wegner, widow of the
<br /> deceased, was devised and bequeathed all personal property of every kind and nature, remaining after the pa�ment of
<br /> debts, funeral expenses, and the costs and expenses of administration of his said estate. That such personal property
<br /> was heretofore assigned, set over and delivered to Meta Wegner. That in addition thereto, under the terms of such
<br /> last will and testament of Herman T. Wegner, deceased, Meta Wegner, widow, was devised a lif'e estate in the real
<br /> estate owned by the deceased, with remainder to certain named children or their spouses which might be living upon the
<br /> death of Meta Wegner.
<br /> (3) Tha,t Meta Wegner departed this life in Hall County, �ebraska, on the 25th dap of November, 1951, and the life
<br /> estate in such real estate has now been deter�ined.
<br /> (4) That under the last will and testament of Herman T. Wegner, deceased, and sabject to the life estate devised
<br /> to Meta Wegner, the deceased Herman T. Wegner gave and bequeathed to'hic dsnghter, Ella Louise Wolfe, also knawn as
<br /> Ella Loaise Wolf, in the event she was living at the date of the death of Meta Wegner, the sum of Fiv� Hundred Dollars
<br /> ($504.00). That Ella Louise Wolfe, sometimes known as Ella Louise Wolf, departed this life on the 31st day of August,
<br /> 1949, prior to the death of Meta Wegner and such bequest bp the terms of the Will on the date of Ella �ouise Wolfe�s
<br /> death lapsed.
<br /> That further, and subject to the life estate devised to Meta Wegner, and provided they were living at the date
<br /> of death of Meta Wegner, the real estate awned by the deceased was devised in equal shares to the following named
<br /> persons:
<br /> To Charley Theodore Wegner,
<br /> Arthur Herman Wegner,
<br /> Elbert Ernst Wegner,
<br /> Richard Bernard Wegner, �
<br /> Freda Marie Wrage, and '
<br /> Arnold Harold Wolfe, also known as Arnold Harold Wolf. � � _
<br /> That such will provided that in the event that any of such named persons should die, prior to the death of. Meta We�ner,
<br /> leaving a wife or husband, and no children him or her surviving, that then, and in that event, the de�ria� to `sucl�
<br /> deceased person should lapse and a devise of 1/12 share and interest in and to such real estate owner! by the deceased
<br /> was made to �the spouse of such deceased.
<br /> That Arthur Herman Wegner died on the 2nd day of July, 1948,, prior to the death of the deceased, and prior to
<br /> the death of Meta Wegner, that the said Arthur Herman Wegner left him surviving his wife, Marie Wegner, but no children,
<br /> or other descendents.
<br /> (5) That the deceased was, in his lifetime, the fee c�+ner of the follawing described real estate, to wit:
<br /> The Southwest Quarter (SW4) of Section Twenty-four (24), Tawnship Twelve (12), North, Range Ten (10), West
<br /> of the 6th P.M., Hall Countp, Nebraska,
<br /> The North One-Half (N�) of the Southeast Quarter (SE4), and the South One-Qnarter (S4) of� the South One-Half
<br /> (S2), of the Northeast Quarter (rTE4) of Section Eleven (11), Township Eleven (11), North, Range ten (10),
<br /> West of the 6th P;M., Hall Countq, Nebraska,
<br /> which, according to the provisions of the last will and testament of said deceased, upon the death of the life tenant,
<br /> Meta Wegner, descended and is assigned as follows:
<br /> To Charley Theodor� Wegner,
<br /> Elbert Ernst Wegner,
<br /> Richard Bernard Wegner,
<br /> Freda Marie Wrage,
<br /> Arnold Harold Wo1fe, sometimes kno�+n as Arnold Harold Wolf, each an undivided 11/60 share in said real cstate;
<br /> To Marie Wegncr, an undivided 5/6Q share.
