<br /> W ILL AND DECREE � ,
<br /> LAST WILL AND TESTAME.fi1T OF HERMAN T. WAGNER
<br /> I, Herman T. Wegner, otherwise known as Herman Wegner, at this time residing on Route 1, Grand Island, Nebraska,
<br /> in Hall County in such state, being of sound and disposing mind and memorp, do make and publish this, my last will and
<br /> testament, hereby revoking any and all former wills by me at any time made.
<br /> FIRST.
<br /> I appoint Emil Mahn and The First National Bank of Grand Island, Nebraska, executors hereof, and direct such
<br /> executors to pap all my just debts, including funeral expenses, and the costs and expenses of administration of my
<br /> �state; first out of any personal property re�aining; and, second, if my personal property is insufficient, out of
<br /> the proceeds of the sale of my real estate other than the one hundred and sixty acres where I naw reside, and in which
<br /> event, I hereby give �v executors above naraed full power and authority to sell any of my real estate other than my
<br /> hot�e one hundred and sixty acres, with out first obtaining a license therefor,
<br /> SECOND.
<br /> I bequeath to my beloved wife, Meta Wegner, to be hers absolutely, any and all of my personal property of whatever
<br /> kind, remaining after the payment of my debts, funeral expenses, and the c osts and expenses of administration of my
<br /> estate.
<br /> TH IRD.
<br /> I give to my wife, Meta Wegner, to her use for and during her life, all the real estate oMmed by me at m�► death
<br /> or remaining to my estate after the papment of my debts, funeral eacpenses, and the costs and expenses of administration,
<br /> which devise is to be in lieu of all provisions made for her bp statute, '
<br /> FOURTH.
<br /> Upon the death of mp wife, Meta Wegner, or at my death if she does not survive me. I bequeath to my daughter,
<br /> Ella Louise Wolf, in the event she survives me or my wife, as the case may be, the swn of Five Hundred Dollars ($500.00),
<br /> which bequest shall be a charge on my real estate. If such daughter does not survive me or n�► wife, as the case may
<br /> be, this bequest shall lapse and be of no force or effect.
<br /> FIFTH.
<br /> Upon the death of my wife, or at my death if she does not survive, I give, devise, and bequeath all of mpr real
<br /> estate and other property then remaining, not otherwise herein dispos�d of, share and share alike, subject to the
<br /> conditions hereinafter set out, to the following named persons :
<br /> Charley Theodore Wegner, my son;
<br /> Arthur Elerman �'�gner, atq� s on;
<br /> E�bert Frnst��ner, my son;
<br /> Richard Bernard Wegner, mq� son;
<br /> Freda Ma,rie Wrage, my daughter, and
<br /> Arnold Harold Wolf, the son of mp daughter Ella Louise Wolf.
<br /> The charge on my real estate, as bequeathed in paragraph fourth hereof, if in force and effect when this
<br /> paragraph fifth becomes effective, shall be paid proportionately bp each and every devisee taking nnder this paragraph,
<br /> fifth, in the exact proportion of the share that he or she takes hereunder.
<br /> In the event any person first named in this para�raph fifth shall die before such paragraph shall take effect,
<br /> leaving a wife or husband and no children him or her surviving, I give, d�.vi.se, and bequeath to such surviving spouse
<br /> of such person, a one-twelfth of the above described propertp, real or personal, and direct that the bequest and
<br /> devise to such deceased person shall lapse, thereby increasing the shares of the survivors of the persons first named
<br /> in this paragraph fifth.
<br /> In the event anq person first named in this paragraph fifth shall die before such paragraph shall take effect,
<br /> leaving no wife or children him or her surviving, I direct that the bequest and devise to such deceased person shall
<br /> lapse, thereby increasing the shares of the survivors of the persons first named in this paragraph fifth.
<br /> In the �vent anp person first named in this paragraph fifth shall die before such paragraph shall take effect, ,
<br /> leaving issue or descendants, I direct that the share of sUCh deceased person sha11 not lapse, but shall go to snch
<br /> issue or descendants; to issue, in equal proportions; to descendants, by right of representation.
