<br /> widow, payment in full of inheritance tax levied and assessed against her, and upon payment of said sums the Executors
<br /> will be released from any liability for the State Inheritance Ta�c.
<br /> The Court further finds that the estate was not subject to Federal Estate �aac.
<br /> The Court further finds that Donald Charles Fairbanks is one and the same person as Charles Donald Fairt�anks
<br /> The Court further finds that the F,xecutors have waived their executorst fees in this case and the court costs are
<br /> the sum of $181.75; that there should be allowed to the F,xecutors the sum of $10f4.00 as attorney fees for Harold A.
<br /> Prince for acting as Attorney for this estate.
<br /> IT IS FURTHER ORDERED, ADJUDGED AND DECRF.ED by the Court that the estate is continued for the pnrpose of filing
<br /> of such 1951 income tax returns as may be necessary f or the said Charles A. Fairbanks and the widow, and after the
<br /> filing of said returns, the payment of the inheritance tax, court costs and attornep fees and the filing of receipts
<br /> therefor, that the real estate mentioned in the said last Will and Testament may be set off in accordance with the
<br /> same and this estate closed.

<br /> Now on this lOth day of ,january, 1952, this cause came on to be heard, and upon the receipts filed, the Court finds
<br /> that the inheritance tax, as ordered by the Court, has been paid in full, both that assessed against the wid aa and
<br /> that assessed against Donald Charles Fairbanks, and that the court costs and attorney fees have been paid in full and
<br /> receipts f iled therefor, and that the income tax returns have been filed.
<br /> IT IS, THEREFORE, ORDERED, ADJUDGED AND DECREED by the Court that the Fxecutors be and thep are herebq discharged.
<br /> The Court finds that Charles A. Fairbanks died testate on June 7, 1951; that he was at the tia� of h is death a
<br /> resident of Hall County, Nebraska, and that this court has jurisdiction; that he left a last Will and Testament and
<br /> Codicil thereto, which have heretofore been admitted to probate, which probate has never been set aside or appealed
<br /> � from.
<br /> The Court further finds that at the time of his death, the said Cta rles A. Fairbanks was the awner of the following
<br /> described real estate, to-wit:
<br /> The East Half of the Southwest Quarter (E2 St�) and the Northwest Quarter of the Southeast Quarter (NW4 SE4) of
<br /> Section Fight (8), Tawnship Ten (10) North, Range Eleven (11), West of the 6th P. M., ia Hall Countp, Nebraska,
<br /> and the same is hereby set off unto the said Danald Charles Fairbanks, who is one and the sa�ae person as Charles
<br /> Donald Fairbanks, in accordance with said last Will and Testament.
<br /> The Court further finds that said Charles A. Fairbanks was the awner at the time of his death of the foll�+ing
<br /> described real estate, to wit:
<br /> The Fast Half of the Southeast Quarter (E2 SE4) of Section Five (5), T�nship Ten (10), North, Range El�ven (11)
<br /> West of the 6th P. M., in Hall Ceunty, Nebraska,
<br /> and the same is t� rebp set off unto the widaw, Anna Fairbanks, for life, with remainder over to the denisees named in
<br /> the last Will and Testament, share and share alike, as tenants in conm�on.
<br /> The Court further finds tha.t the �aid Charles A. Fairbanks was at the time of his death the o�,mer of the following
<br /> described real estate, to-wit:
<br /> Lots One (1), Two (2), and three (3) in Block 'I�+o (2), Clarkts Addition the the Town of Wood River, Hall County,
<br /> Nebraska,
<br /> and had an interest in Lot Fine (5) in Block Twentp-eight (28) in Charles Wasmerts Addition to the City of Grar�d Island,
<br /> Nebraska, and that the same is hereby set off in accordance with said last Will and Testament, unt o the widaw, Anna
<br /> Fairbanks.
<br /> The Court further finds that all other property awned by the said Charles A. Fairbanks at the time of his death,
<br /> whether real, personal or mixed, be and the same is her�by set off unto his widaw, Anna Fairbanks, to be hers absolutely.
