<br /> This matter came on for hearing on the 18th day of April, 1951, upon the petition of Frank Shaffer and Rosie F.
<br /> Shaffer, praying that the court may find and determine the time of the death of the said John H. Schultz, deceased,
<br /> and who the heirs at law of the said John H. Schultz, deceased, were at the time of his death, the degree of kinship
<br /> and the right of descent of the said real estate in said petition described. Testimony was taken and the matter
<br /> submitted to the Court for Decree, and the Court being fu.11y advised in the premises finds:
<br /> That the Court has heretofore fixed the time for hearing on said petition and that notice of the time and place
<br /> � of hearing was duly given to all persons interested in said estate as required by law, and the Court now has full
<br /> jurisdiction to hear and determine said matter, and the court further finds that the said John H. Schultz, departed
<br /> this life intesr.ate in Nall Coimty, Nebraska, on or aboi�t the 9th day of July, 1941, and that at the time of his
<br /> death, he was a resident of Hall. County, Nebraska.
<br /> The Court further find.s that the decedent died intestate seized in fee simple of an estate of inheritance in
<br /> the State of Nebraska, and that at the time of his death, said decedent was seized in fee simple of the following
<br /> described real estate, to-wit;
<br /> The North Half of the following described tract of land, more particularly descrihed as follows:
<br /> Commen�ing at the fiorthwest Corner of Lot Four (4) in «Fairacres SuhdivisionT�, located on part of the
<br /> Southwest Quarter of Section Three (3), in Township Eleven (11), North, Range Nine (9), West of the
<br /> 6th P.M., running thence Fast 212 feet parallel with the North line of said Lot 4, thence South 204
<br /> feet parallel with the [aest line of said Lot 4, thence West 212 feet, parallel with the North line
<br /> of said Lot 4, thence North 204 feet, parallel with the Ldest line of said Lot 4, to the place of �;
<br /> beginning, Hall County, Nebraska.
<br /> That an application was made for the appointment of an Administrator in the County Court of Hall County, Nebraska,
<br /> by the heirs of the said Tohn H. Schultz, deceased. That the said estate has been closed, but there has been no valid
<br /> decree of heirship entered in the probate of such estate.
<br /> The court further finds that said estate is not subject to inheritance tax, and that the petitioners are the
<br /> owners of said real estate hereinbefore described, having acquired title thereto by mesne conveyances.
<br /> The court further finds that the wife of the said John H. Schultz, predeceased him, and that the said ,John H.
<br /> Schultz, deceased, left him surviving as his sole and only heirs at law, the following named persons, to�ait:
<br /> Dora Katherine (Schultz) Collins, datighter, and Henry Andrew Schultz, son; and that title to the within described
<br /> real estate descended to and vested in the above named heirs of said deceased.
<br /> IT IS, THERFFORE, ORDi,RED, ADJUnGED AI�D DF.CR[;rD BY TH� COIJRT that the said ,John H. Schultz, deceased, departed
<br /> this life intestate more than two years prior to the filing of the petition herein, to-wit; On the 9th day of July,
<br /> 1941, and thar, he left him surviving as his sole and only heirs at law, the following named persons, to-wit; Dora
<br /> Katherine (Schultz) Collins, daughter, and Henry Andrew Schultz, son; and by reason of the premises, fee simple
<br /> title to the real estate, to-wit:
<br /> The l�orth Half of the following described tract of land, more particularly described as follows:
<br /> Commencing at the Northwest Corner of Lot Four (4) in TfFairacres Subdivision«, located on part of the
<br /> Southwest Quarter of Section Three (3), in Township Fleven (11), North, Range I�ine (9), West of the
<br /> . 6th P.M., running thence East 212 feet parallel with the rorth line of sai.d Lot 4, thence South 20a
<br /> feet parallel with the West line of said Lot 4, thence West 212 feet, parallel with the North line of
<br /> said Lot 4, thence North 204 feet, parallel with the West line of said Lot 4, to the place of beginning,
<br /> Hall County Nebraska;
<br /> descended to and vested in the above named heirs at law of the said ,john H. Schultz, deceased,
<br /> Dated this 18th day of Apri.l, 1951.
