<br /> I Now on this ].6th day>..of May, 1929, this matter came on for hearing ,on the final report of the administrator
<br /> filed herein the l8th day of April, 1929, after due notice by publication, as by law and the order of this Court
<br /> r�quired, had been given to all persons interested as to the time fixed and place appointed for hearing said report,
<br /> and there being no orjections thereto, and noene appearing in person to object, the Court examined said report, and
<br /> being fullp advised in the premises, firids that' said report is correct and that it should be approved and allowed as �
<br /> and for his final accounting.
<br /> IT IS THEREFORF �RDERED, adjudged and decreed that the final report of the administrator be and the same is,
<br /> hereby approved and allowed as and f or his final accounting.
<br /> The Court further finds that due and legal notice was given to all the creditors and other persons interested
<br /> as to the time fixed and 'place appointed for filing claim� against said estate, and that said time has fullp elapsed
<br /> and expired, and that all claims filed have been paid ana ful.ly satisfied, and that any claiins not so' filed, if any

<br /> IT' IS THEREFORE ORDERF.D, adjudged and decreed that all claims filed against said estate have been pai� and fully
<br /> satisfied and that any claims net so filed, if any such there be, sho�tld be forever barred and precluded.
<br /> The Court further finds that Helena Wagner, who was also known as Helene Wagner, departed this life on the f�th
<br /> day of Augvst, 1928, while a resident and inhabitant of Jeff@rson County, Nebraska, and that she died intestate;
<br /> that �aid Helena Wagner was the widow of Adam Wagner, deceased, and was unmarried at the time of her death• th�t she
<br /> �
<br />� left surviving her as her heirs at law and only heirs at law, Adam J. Wagner and Louis Wagner, her sons, Mary Wagner,
<br /> Susie Taylor Barr�tt, and Lena Fisher, her daughters, al1 �f whom are of lawful age; that said Helena Wagner, at the
<br /> i time of her death, was the owner in fee af - � - �-` � � ` -
<br /> an undi�ided three-sevenths (3/?) interest in and to the southeast quarter (SE�) of section four (4) .
<br />' and the northwest quarter (b'W,�-�) of Section ten (10), Township two (2) North, Range three (3) east of
<br /> the 6th P. M., and the south half (S2) of Section seven (?), Township two (2), North, Range four (4),
<br /> east of the 6th P.M. and that she was the owner of the entire fee in and to the northerly forty-four
<br /> (44) feet of Lots One (1) anci two (2) in Block four (4) of the original Town now Citp of Grand Island,
<br /> Hall County, Aebraska, . � . . -'
<br /> and that she was possessed of personal property as listed in the inventory filed in this Court on the 15th day of
<br /> October, I92$; that upon the death of said HeZena Wagner, all of her property, both real and personal, did pass and
<br /> descend by operation of law, to Adam J. Wagner, Louis Wagner, Mary Wagner, Susie Taylor Barrett and Lena Fisher, in
<br /> equal shares;
<br /> The Court further finds that the personal property has been distributed to the parties entitled thereto as
<br /> shown by the final report of the a3ministrator and receipts for same have been fi2ed; the court further finds that
<br /> there is no inheritance ta�c due,
<br /> IT IS mtiERFFQP.E ORDF.RrD, adju3ged and decreed that Nelena Wagner who was also known as Helene Wagner, departed
<br /> this life on the 8th day of August, 1928, while a resident of Jefferson Co�.mty, Nebraska, and that she died intestate
<br /> and that she left surviving her as her heirs at law and only heirs at law, Adam J. Wagner, Louis Wagner, Mary Wagner,
<br /> Susie Taylor Barrett, and Lena Fisher, her children, her husband having preceeded her in death; that she was the
<br /> owner of an undivided three-sevenths (3/�) interest in and to the south�ast quarter (SE4) of Section four (4) and
<br /> the northwest quarter (NWn) of Section ten (10), a71 in Township two (2) North, Range three (3), east of the 6th
<br /> P. M. and the south hal.f (S�) of Section seven (7), Township two (2) North, Range four (4), east of the 6th P. M.,
<br /> and of the entire fee in and to the north fo�!ty-four feet of Lots one (1) and two (2) in Block four (4) of the
<br /> original Town naw City of �ran.d Island, Nebraska, and that she was possessed of personal property as shown by the
<br /> inven�orp filed herein. That upon the death of said Helena idaguer, all of said property did pass and descend by
<br /> operati.on of Iaw, to Adam �. Wagner, Loui.s Wagner, Mary Wagner, Susie Taylor Barrett, and Lena Fisher, in equal
<br /> shares and the same is hereby awarded to them to be theirs forever and said estate is cl.osed, the administrator
<br /> discharged, and hi.s bond released.
