<br /> LAST WILL AND TESTAMENT
<br /> OF
<br /> ROBERT W. MUIRHEAD
<br /> I, Robert W. Muirhead, of Grand Island, Hall County, Nebraska, being of sound mind and d3,sposi.ng memory, do make,
<br /> publish and declare this to be my Last Will and Testament in manner and form as follows:
<br /> FIRST
<br /> I revoke any and all Wills heretofore made by me.
<br /> SECOND
<br /> I direct that mp executri.x hereinafter named shall pay all of my just debts, funeral expenses, and expenses of
<br /> last illness as soon after m� death as can convenientlp be done.
<br /> THIRD
<br /> All the rest, residue and remainder of my propertp, both real estate and personal property, whether now oWned bp
<br /> me or hereafter acquired and wheresoever situated, I give, devise aand bequeath to my beloved wife, Helen Muirhead, to
<br /> have and to hold the same forever; provided, however, that i.n the event she should precede me in death or her death
<br /> should occur within sixty days after �y death as the result of a common accident resulting in the deaths of both of
<br /> us, then and in that event, I direct that my estate shall be divided, one-half in equal shares among upr brothers and
<br /> sisters surviving me, or if anp of n� brothers and sister� precede me in d�ath leaving issue surviving them, then to
<br /> such issue by right of representation, and the other one-half shall be divided among the brothers and sisters of m�y
<br /> wife in equal shares, with the same provision that if any of them precede me in death leaving issue surviving, such
<br /> issue shall take by right of representation.
<br /> FOURTH
<br /> I name, nominate and appoint my wife, Helen Muirhead, to be the executrix of this, my Last Will and Testament,
<br /> further prowidin� that she shall not be required to give surety on her official bond as such, and granting tu her full
<br /> right and authority to sell real estate owned by me �ithout license or authoritp from anp court for that purpose. In
<br /> the event she does not survive me or does not qualify as e�cecutrix, then I appoint my brother-in-law, Hans Lueth, of
<br /> Grand Island, Nebraska, to be the executor, and also mp brother-in-law, William Gerbi�, as join� executor.

<br /> I, Charles Bossert, Judge of the County Court, in and for said Countp, do hereby certify that on the 24th day of
<br /> July 1950, the instrument purporting to be the last will and testament of Robert W. Muirhead deceased, was filed for
<br /> probate in this Court. That on the 23rd day of August 1950, said instrument to which this certificate is attached was
<br /> duly proved, probated and allowed as the last will and testament of the real and personal estate of said Robert W.
<br /> Muirhead deceased, and the same was ordered to be recorded in the records of the Court aforesaid.

<br /> ROBERT W. MUIRHEAD, Deceased. )
<br /> On the 24th day of January, 1951, this ma.tter came on to be heard and was continued to the Sth day of February,
<br /> 1951. Now on this Sth day of February, 1951, this ma.tter came on for hearing on the final account of Helen Muirhead,
<br /> executrix of the Last Will and Testament of said deceased, and the petition of said executrix for an assignment of
<br /> said estate to her as sole legatee and also for a finding and judgment decreeing said estate to not be subject to an
<br /> inheritance tax and said ma.tters were submitted to the Court upon the pleadings and the evidence, upon consideration
<br /> whereof� the Court finds, from proof on file, that all persons interested in said estate have been duly notified, as
<br /> required by law and the orders of the court, and after a full examination of said account, the Court finds that the
<br /> same is correct in all respects and should be, and is hereby, approved and allowed. The Court also finds that no
<br /> clairns were filed in said estate, and that all further claims are barred by the former order of this Court, and that
<br /> there remains of said estate an undivided one-half interest in and to the South Fifteen and two-thirds (15 2/3) feet
<br /> of Lot One (1) and the North Thirty-one and one-third (31 1/3) feet of Lot Two (2), in Block One (1) of Heydefs -
<br /> Additian to the City of Grand Island, Hall County, Nebraska. The Court further finds that the executrix of said Will
<br /> is the widow of said deceased and the sole legatee and devisee of said estate. That as the widow of said deceased,
