<br /> The Court further finds that on the 22nd day of July, 1950, �aid Otto Schmidt, Executor of said Estate, filed ' ` .
<br /> in this Court his inventory of the property of said estate, and that according to said inventory, the deceased died' '
<br /> seized and possessed of the following described property, to-wit:
<br /> Lot Si�c (6) in Block Eight (8) in Rollinst Addition to the Citp of Crand Island, Hall County, Nebraska;
<br /> The East Half of the Northeast Quarter (E2NE4) of Section Seventeen (17) in To�mship Eleven (11)
<br /> North, Range Fourteen (14) West of the 6th P.M. in Buffalo County, Nebraska,
<br /> both of the above described tracts being of record in the name of Mathilda Schmidt, whose real and true name was
<br /> Mathilde Schmidt.
<br /> Personal Propertq of the approximate valae of $4,172.85. The Court further finds that according to the
<br /> terms, conditions and provisions of said Last Will and Testament of sa�:d deceased, said property was devised and
<br /> bequeathed, share and share alike, unto Otto Schmidt,. Herraan A. Schmidt, William R. Schmidt, Hugo Schmidt,
<br /> Emma L. Wivell, and Antonette Schmidt, in fee simple absolute.
<br /> 5IXTH
<br /> Tl�e Court further finds that on the 18th day of November, 1950, an order of this Court was made allowing
<br /> the claim of Emma Wivell in the swn of $75.00 and the claim of Antonette Schmidt in the sum of $1,000.00, against
<br /> this estate, and barring the filing of anp and all other claims against said estate and excluding and en3oining
<br /> the holders of any such other claims from setting up or asserting the sam� against said estate.
<br /> SEVENTH
<br /> The Court further finds that all claims against said estate, including the expenses of the last illness
<br /> and burial and administration of this estate, have been fully paid by said Execntor and that the Final Report of
<br /> said Executor is correct in all respects and should be approved and allowed; that there remains in the hands of
<br /> said Executor. the sum of $3,409.93, which sum, according to the terms and provisions of said Last Will and
<br /> (5) Testament is payable and distributable as follows:
<br /> Otto Schmidt - $568.32
<br /> Herman A. Schmidt - �568;�2
<br /> William R. Schmidt - 568.32
<br /> � Hugo Schmidt - 568.32
<br /> En�ma L. Wivell - 568.32
<br /> Antonette Schmidt - 568.33
<br /> The Court further finds that this estate is sub�ect to the payment of no Federal Estate Taac whatsoever, and
<br /> that there is due and payable to the County Treasurers of Hall County, and Buffalo Coc�ntq, Nebraska, no inheritance
<br /> tax herein whatsoever, for the reason that the real estate in Ha11 County, Nebraska, was at the time of the death
<br /> of said decedent of the value of $10,500.00, and the real estate in Buffalo Countp, Nebraska, was at the time of
<br /> the death of said Decedent, of the value of $8,000.00;
<br /> IT IS THEREFORE ORDERED, ADJUDGED AND DECREED BY THE C4URT that the Final Report of Otto Schmidt� Executor,
<br /> be and the same is hereby approved and allowed as such; that Mathilda Schmidt and Mathilde Schmidt, hereinbefore
<br /> named, are one and the same and identical persons, irrespective of the discrepancy in the spelling of said names
<br /> as they appear of record with respect to the real estate hereinbefore described; that the property described in
<br /> Paragraph Fifth herein was devised and bequeathed according to the terms and provi�ions of said Last �Jill and
<br /> Testament as found in said Para ra h Fifth hereof• that there remains in the hands of said Executor the sum of _

<br /> $3,409.93 for distribution, and upon payment thereof, to the persons found to be entitled thereto in Paragraph
<br /> Fifth hereof, and upon said Executor filing rcceipts showing such payment with this Court, that he be discharged,
