<br /> That Mathilde Schmidt departed this life on the 26th day of ,]une, 1950, at her residence in Grand Island,
<br /> in Hall County, Nebraska, testate, and at the time of her death she was a resident of Hall County, Nebraska.
<br /> SECOND (g)
<br /> That on the 30th day of June, 1950, Otto Schmidt filed in this Court an instrument purporting to be the
<br /> i Last Will and Testament of said Ma.thilde Schmidt, deceased, wherein said petitioner was named Executor, and a
<br /> petition offering said Will for probate, and on the 30th day of June, 1950, an order of this Court was made therein
<br /> assigning the 22nd day of Julp, 1950, at 10 o�clock a.m. in the County Court Room in said County as the time and
<br /> place for hearing said petition, proving said Will and admitting the same to probate and ordering that notice of
<br /> the pettdency of said petition and hearing thereon be given to all persons interested in said matter by publishing
<br /> said notice in the Grand Island Independent, a legal newspaper printed in said Conntp, for three successive weeks
<br /> prior to said day of hearing, and it appears by proof on file that notice of said order was so given.
<br /> THIRD
<br /> The Court further finds that on the 22nd day of July, said instruraent was proven, a1loWed and admitted
<br /> to probate as the Last Will and Testament of said Mathilde Schmidt, deceased, which Last Wi�l and Testament is in
<br /> words as follows:
<br /> " THE LAST WILL OF MAl�L� SCHMIDT
<br /> I, Mat�,lda Schmidt, make this my last will hereby revoking all former wills.
<br /> I appoint my dearly beloved son Otto Schmidt executor of this will but he need give no bonds.
<br /> ,
<br /> Th�e:=expenses of my last illness and of my burial shall be paid as soon as possible out of the moneys on
<br /> hand or out of any monies due me from any source whatever.
<br /> All my property, real estate and personalt� I give, devise and bequeath unto my six children in equal
<br /> parts and to their heirs and assigns forever, to wit: To m�y daughters Em�a and Antoniette, and my sons Otto,
<br /> Herman, William and Hu�o.
<br /> Done at Crand Island, Nebr, this 19th day of June, A.D. 1935.

<br /> I, Charles Bossert, Judge of the Countp Court in and for said Countp, do herebp certify that on the 30th
<br /> day of �une, 19�, the instrument purporting to be the last will and testament of Mathilde Schmidt, deceased, was
<br /> filed for probate in this Conrt. That vn the 22nd day of July, 1950, said instrument to which this certificate is
<br /> attached was duly proved, probated and allowed as the last Will and testament of the real and personal estate of
<br /> said Mathilde Schmidt, deceased, and the same was ordered to be recorded in the records of the Court aforesaid.

<br /> at the time of her death Was a widow and that she left the follo�+ing heirs-at-laW, and only heirs-at-law, to-�►it:

<br /> The Court further finds that on the 22nd day of Julq, 1950, an order of this Court was made a1loWing
<br /> creditors three months from and after the 16th day of August, 1950, in which to file their claims againsti said
<br /> estate, and said Executor one year in which to settle said estate, and further ordering that notice to creditors
<br /> be published in the Grand Island Independent, a legal newspaper published and circulating in Hall County, Nebraska,
<br /> for three successive weeks prior to the 16th day of August, 1950, and that a hearing on claims filed against said
<br /> estate would be held at the office of the County Judge of Hall County, Nebraska, on the 18th day of November,
<br /> 1950, at 9 otclock a.m., and it appears by proof on file that notice of said order was published as ordered bp (3)
<br /> this �ourt.
