<br /> LAST WILL AND TESTAMENT OF
<br /> BERT PHILLIPS.
<br /> I, B�rt Phillips, of Grand Island, Nebraska, being of sound mind and disposing m�mory, do make, publish and
<br /> declare this my last will and testament, in the manner and form following:
<br /> FIRST; It is my desire and I direct that all my �ust debts, if any, funeral expense and expenses of my last illness
<br /> be paid by my executrix, hereinafter named.
<br /> SECOND: Subject to the fore�oing, I give, devise and bequeath to my wife, Kattie Phillips, all of the personal
<br /> property and all of the real estate and any other property which I may have at the time of my death, she to have the
<br /> same absolutely.
<br /> THIRD: I hereby authorize and empower my executrix to sell any or all my personal and real property during the
<br /> administration of my estate, or after administration of my said estate, without application to or authority from any
<br /> court whatsoever, my intention being to give her absolute unrestricted power to dispose of said real estate and
<br /> personal property at all times.
<br /> FOURTH: I hereby name, nominate and appoint my wife, Kattie Phillips, as executrix of this mp last wi11 and testament,
<br /> and I request that she not be required to give any bond as such executrix.
<br /> FIFTH; I hereby revoke any and all former wills bp me made.
<br /> IN WITNESS WHEREOF, I have hereunto signed my name to the foregoing instrument, consisting of one page of type-
<br /> written matter, at Grand Island, Hall County, Nebraska, this 3rd day of May, 1939.

<br /> I, Charles Bossert, Judge of the County Court, in and for said County, do hereby certify that on the 24th day of
<br /> September I949, the instrument purporting to be the last will and testament of Bert Phillips deceased, was filed for
<br /> probate in this Court. That on the 4th day of January 1950, said instrument to which this certificate is attached was
<br /> duly proved, probated and allowed as the last will and testament of the real and personal estate of said Bert Phillips
<br /> deceased, and the same was ordered to be recorded in the records of the Court aforesaid.

<br /> Now on this lst day of November, 1950 this cause came on for hearir� upon the �inal Report of Kattie Phillips,
<br /> executri.x of the estate of Bert Phillips, deceased, praying for approval of her report and for her discharge as such
<br /> executrix, and it appearing to the Court from the proof on file that the said Kattie Phillips has accounted for all
<br /> property comin� into her hands as executrix of said estate, and that her report is correct and ought to be allowed;
<br /> that due notice was given to all persons interested in said estate and the time and place of the hearing on said
<br /> report, as provided by law and the order of this court.
<br /> IT IS, TI�REFORE, ORDERED, ADJUDGED AND DECREED BY THE COURT that the final report of Kattie Phillips, executrix,
<br /> is correct and same is hereby approved and allowed.
<br /> The court further finds that the said Bert Phillips departed this life on the lOth day of September, 1949; that
<br /> he was immediately preceding his death a resident of Hall County, Nebraska; that he left a Last Will and Testament
<br /> which was duly proven and allowed to probate in this court under d�.te of January 4th, 1950; that Kattie Phillips was
<br /> appointed executrix, gave bond as such; that she has paid all of the debts of the deceased, the funeral expenses, the
<br /> expenses of the deceasedts last illness, the court costs and attornep fees, and that if there are any outstanding
<br /> claims a�ainst said estate not filed in the time fixed by the court, that the same are forever barred and precluded.
<br /> The court further finds that under the terms and provisions of the Last Will and Testament of Bert Phillips,
<br /> deceased, that all of the property of which he died possessed, passed and descended to Kattie Phillips, his widow, in �,
<br /> absolute title; that said property is hereby awarded to her.
<br /> The court further finds that there was not sufficient cash on hand to pay all claims and that the said Kat?tie
<br /> Phillips advanced the sum of $158.64 of her personal funds and that she makes no claim against said estate for the
<br /> funds so advanced.
<br /> The court further finds that the said Bert Phillips was, at the time of his death, the owner of the following
<br /> described real estate, to-wit:--
