<br /> I, B. J. GUINAN, of Kansas City, .County of Wyandotte and State of Kansas, being of sound and disposing miad and
<br /> memory, but mindful of the uncertaintp of life, and desiring to make provision for the disposition of my property and
<br /> affairs while in strength of body and mind, do make, publish and declare this to be my last will and testament, herebp
<br /> revoking all other or former wills by me at any time made.
<br /> FIRST, I direct that all my just debts, including funeral expense, be paid by my F�cecutrix as soon as may be
<br /> fovnd convenient,
<br /> SECOND, I herebp devise and beQueath all of my estate, both real and personal of whatsoever nature and wheresoever '
<br /> situated, to �hich I may be entitled, or which I raay have pawer to dispose of at my decease, unto my dear �*ife,
<br /> Minnie B. Guinan, absolutely. I make this disposition of my property because of the great love and affection that I
<br /> have for my said wife, Minnie 8. Guinan, and knowing that she will provide amply for our minor daughter, Alice May
<br /> Guinan.
<br /> THIRD, I hereby nominate, constitute and appoint my said wife, Minnie B. Guinan, as the Executrix of this my
<br /> last wi11 and testament, and hereby request that she map be allowed to qualify and serre as Executriac without giving
<br /> and bond or security whatsoever.
<br /> IN WITNESS WHEREOF, I, B. J. Guinan, have signed sealed, published and declared this to be my last Will and

<br /> Now on this 6th day of December, 1950, this matter came on bef'ore the Court for hearing upon the pleadings and
<br /> the evidence and was submitted to the court.
<br /> The court, after being fully advised in the premises and after due and eareful consi�eration, finds;
<br /> That notice of this proceeding has been given to all persons interested, both creditors and heirs and to the
<br /> Countp Attorney of Hall County, Nebraska, as required by law; that the allegations of the petition are true; that
<br /> Bernard J. Guinan, also known as B. J. Guinan, died on the 19th daq of July, 1948, a resident and inhabitant of Kansas
<br /> City, Wyandotte County, Kansas; that he died testate and that the instrument filed herein purporting to be his last
<br /> will and testament is the last will and testament of the said Bernard J. Guinan, also known �.s B. J. Gninan, and that
<br /> said last will and testament has been proven according to law;that your petitioner is the executrix named in and is a
<br /> person interested in such will as the sole devisee and legatee; that such Bernard J. Guinan a.lso knawn as B. J. Guinan, ,
<br /> died seized of real property situated in the county of Hall in the State of Nebraska, that more than two pears have �
<br /> elapsed sinc� the death of such Bernard J. Guinan and there has been no administration of his estate in the State of
<br /> Kansas or in the State of Nebraska; that such instrument should be allowed and admitted to probate in the state of
<br /> Nebraska as the last will and testament of such deceased; that regnlar administration of such estate shall be
<br /> dispensed with and a decree entered findin� that such estate in theState of Nebraska descended free of all debts
<br /> against the decedent and such estate, and the share therein of the petitioner, Minnie B. Guinan, is and are not
<br /> subject to inheritance tax.
<br /> IT IS, THEREFORE, CONSIDERED, ORDERED AND DECREED that said will be and the sa�me hereby is dulp proved, approved,
<br /> probated and allowed as the last will and testament of said Bernard J. Guinan, also known as B. J. Guinan, deceased, ,
<br /> and the sa.me is hereby ordered to be recorded as provided by law.
