<br /> This matter came on to be heard this �th day of September, 1950, on the petition of Eva Boyden,
<br /> owner of an undivicled one-third (1�3) interest 3.n and to the f'ollowina; described real estate:
<br /> Northeast Quarter (NE4) of Section Thirty-four (3�+) , in Township Twelve (12) , D'orth,
<br /> Ran�e Eleven (11) , �dest of the Sixth P.M. , in Hall County, Nebraska,
<br /> and on the answer of P. J. Barrett, Guardian ad Litem, said Guardian Ad Litem representin�; heirs or
<br /> other claimants who miaht be in milit�,ry service of the United States of America or any of its
<br /> allies , and the Court havinm ex�.mined the file and havinn� found that publication as provided by
<br /> law has been had, proceeded to the takin� of testimony.
<br /> THE COURT FINDS that the -petitioner, Eva Boyden, is the owner in fee simple title of an
<br /> undivided one-third (1/3) interest in and to the followin� described real estate:
<br /> Northeast Quarter (1VE�) of Sectiqn Thirty-four (3�), in Township Twelve (12 ) , North,
<br /> Ranme Eleven (11) , '�Jest of the Sixth P.M. , in Hall County, Nebraska.
<br /> THE COURT FURTHER FINDS that John Porter departed this life in Greeley County, Nebraska, on
<br /> Aumust 12, 1932; that John Porter was, at the time of his death, a resident and inhabitant oP
<br /> C�reeley County, Nebraska. That at the time of his deatn he was the owner in fee simple title of
<br /> an undivided one-seventh (1�7) interest in and to the above described real property.
<br /> THE COURT F'JRTHER FINDS that John Porter left survivinm him as his heirs and only heirs at
<br /> law, the followin� named persons whose relationship to the deceased and the interest acquired by
<br /> them by reason of the death of the deceased in the above described real property, is shown
<br /> opposite their names :
<br /> May Porter, widow, an undivided 1�21 interest
<br /> Ethel 7,ie�ler, dau�hter, an undivided 1/63 interest
<br /> Glen Porter, son, an undivided 1/63 interest
<br /> Bessie Marie Porter, dau�hter, an undivided 1/63 interest
<br /> Cha.rles W. Porter, son, an undivided 1/63 interest
<br /> Florence Porter, dau�hter, an undivided 1�63 interest
<br /> Edna Porter, daur�hter, an undivided 1�63 interest
<br /> That more than two years have elapaed since the death of the deceased, and that no administrator
<br /> has been appointed for his estate in Nebraska; that the deceased died intestate and that the above
<br /> deseribed real estate de�cended in accordance with the intestate laws of Nebraska.
<br /> THE CO+JRT FURTHER FINDS �hat no claims have beerl filed a�ainst said estate and that if any
<br /> claims be outsta.ndinr� amair.st said estate, the same are fully barred by operation of law; that
<br /> said estate is �ot subJect to any esta.te or inheritance tax.
<br /> IT IS, THEREFORE, ORDERED, ADJUD�ED AND DECREED BY THE COURT that the petitioner is the owner
<br /> in fee simple title of an undivided one-third (1/3 ) interest in and to the followin� described real
<br /> eatate:
<br /> Northeast Quarter (NE�) of Section Thirty-four (34) , in Township Twelve ( 12) , North, Ran�e
<br /> Eleven (11 ), �nTest of the Sixth P.M. , in Hall County, Nebraska,
<br /> that the deceased, John Porter, departed this life in Greeley County, Nebraska, on Aunust 12, 1932,
<br /> he bein� at that time a resident and inhabitant of C+reeley County, Nebraska; that at the time of
<br /> his death he was the owner of an undivided one-seventh (1/7) interest in and to the above described
<br /> real estate; that he left survivin�^ him as his heirs and only heirs at law, the followino� named
<br /> persons, relationship beinm as shown opposite their names:

<br /> Nebraska the above described real estate did pass and c�escend to the heir.s oP the deceased as shown
